AMENDED SUMMONS NOTICE: YOU HAVE BEEN SUED BY THE ABOVE-NAMED PETITIONER. THE COURT MAY ENTER A JUDGMENT AGAINST YOU WITHOUT FURTHER NOTICE UNLESS YOU RESPOND WITHIN 21 DAYS. READ THE INFORMATION BELOW. TO: CARL RYAN AUDAGNOTTI: Pursuant to Idaho Code 16-2009, you are hereby notified that a Petition for Termination of Parental Rights has been filed against you, a copy of which is attached to this notice. This petition seeks to permanently sever all legal rights, privileges, duties, and obligations between you and your child(ren), including rights of inheritance, pursuant to Idaho Code § 16-2011. You are hereby notified that in order to defend this lawsuit, an appropriate written response must be filed with the above designated court at Ada County Courthouse, 200 W. Front Street, Boise Idaho 83702; phone number (208) 287-6900, within 21 days after service of this Summons on you. If you fail to respond, the Court may enter judgment against you as demanded by the Respondent in the Complaint/Petition. A copy of the Complaint/Petition is served with this Summons. If you wish to seek the advice of or representation by an attorney in this matter, you should do so promptly so that your written response, if any, may be filed in time and other legal rights protected. An appropriate written response requires compliance with Rule 2 and other Idaho Rules of Civil Procedure and Idaho Rules of Family Law Procedure and must also include: 1. The title and number of this case. 2. If your response is an Answer to the Complaint/Petition, it must contain admissions or denials of the separate allegations of the Complaint/Petition and other defenses you may claim. 3. Procedure for Requesting Counsel: To request a court-appointed attorney, you must immediately complete a "Financial Statement/Affidavit of Indigency" and submit it to the Court Clerk. 4. Proof of mailing or delivery of a copy of your response to Respondent's attorney, as designated above. To determine whether you must pay a filing fee with your response, contact the Clerk of the above-named court. You are further notified that you have the right to an attorney as follows: 1. Right to Representation: You have the right to be represented by an attorney in all proceedings before this court. 2. Right to Court-Appointed Counsel: If you are financially unable to employ an attorney, you have the right to have an attorney appointed for you at public expense, provided such representation is constitutionally required. 3. Procedure for Requesting Counsel: To request a court-appointed attorney, you must immediately complete a "Financial Statement/Affidavit of Indigency" and submit it to the Court Clerk. 4. Time Limit: You should contact an attorney as soon as possible to prepare for future hearings in this matter. IF YOU FAIL TO APPEAR at a hearing when scheduled, the court may proceed in your absence, which may result in the permanent termination of your parental rights.
