Ordinance NO. ORD-15-26
BY THE COUNCIL CORLESS, HALLYBURTON,
MORALES, NASH, STEAD AND WILLITS.
AN ORDINANCE REPEALING BOISE CITY CODE TITLE 3, CHAPTER 8, AUCTIONS AND AUCTIONEERS; PROVIDING FOR A WAIVER OF THE READING RULES; AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, existing Boise City Code Title 3, Chapter 8, entitled "Auctions and Auctioneers," governs the licensing of sellers who wish to conduct auction sales within the City; and,
WHEREAS, there has been only one request for this City-issued license for the past several years; and,
WHEREAS, there have been no public complaints to the City regarding auctions for as long as current staff can recall; and,
WHEREAS, the City desires to simplify the City Code and deregulate in areas with low risk or activity.
BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF BOISE CITY, IDAHO:
Section 1. That existing Boise City Code Title 3, Chapter 8, entitled "Auctions and Auctioneers", shall be, and hereby is, repealed and stricken from Boise City Code.
Section 2. That pursuant to the affirmative vote of one-half (1/2) plus one (1) of the members of the full Council, the rule requiring two (2) separate readings by title and one (1) reading in full be, and the same is hereby, dispensed with, and accordingly, this Ordinance shall be in full force and effect immediately upon its passage, approval, and publication.
