Ordinance NO. ORD-17-26
BY THE COUNCIL CORLESS, HALLYBURTON,
MORALES, NASH, STEAD AND WILLITS.
AN ORDINANCE REPEALING BOISE CITY CODE TITLE 3, CHAPTER 1, ARTICLE B, GOING OUT OF BUSINESS, CLOSING OUT SALES; PROVIDING FOR A WAIVER OF THE READING RULES; AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, existing Boise City Code ("BCC") Title 3, Chapter 1, Article B, entitled "Going Out of Business, Closing Out Sales," governs the licensing of sellers who wish to hold a going out of business (liquidation) sale; and,
WHEREAS, despite there having been countless going-out-of-business sales, there have been no requests for such City-issued license for several years; and,
WHEREAS, Idaho Administrative Procedural Act ("IDAPA") addresses sellers who use unfair or deceptive practices for advertising and conducting going-out-of-business sales under IDAPA 04.02.01.090 and 091; and,
WHEREAS, the City desires to simplify the City Code and to remove provisions that are unenforced and redundant to Idaho State statutes and regulations.
BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF BOISE CITY, IDAHO:
Section 1. That existing Boise City Code Title 3, Chapter 1, Article B, entitled "Going Out of Business, Closing Out Sales", shall be, and hereby is, repealed and stricken from City Code.
Section 2. That pursuant to the affirmative vote of one-half (1/2) plus one (1) of the members of the full Council, the rule requiring two (2) separate readings by title and one (1) reading in full be, and the same is hereby, dispensed with, and accordingly, this Ordinance shall be in full force and effect immediately upon its passage, approval, and publication.
