IN THE DISTRICT COURT OF THE FOURTH JUDICIAL DISTRICT OF THE STATE OF IDAHO, IN AND FOR THE COUNTY OF ADA In the Matter of the Application of Aspen Rae Varnes, For a Name Change of a Minor Child Case No. CV01-26-07825 NOTICE OF HEARING ON NAME CHANGE (Minor) A Petition to change the name of Aspen Rae Varnes, a minor, now residing in the City of Boise, State of Idaho, has been filed in the District Court in Ada County, Idaho. The name will change to Aspen Rae Windsor. The reason for the change in name are as follows: On or about April 14, 2026, in State of Idaho Plaintiff vs. Billy Austen Varnes Defendant, Canyon County District Court criminal case number CR14-25-15662, the Court found Billy guilty of two (2) felony level crimes of Children-Lewd Conduct with Child Under 16 and Child Sexual Abuse by Causing or Having Sexual Contact with a Minor Under 16 YOA, and the Court sentenced Billy to State Prison confinement for a determinate period of 13 years. Jessica has been the sole caretaker of Aspen for the majority of her life, Jessica is a great parent to Aspen, and Jessica and Aspen have a loving and healthy parent child relationship. Jessica has sole legal custody and sole physical custody of Aspen, which she was awarded in the Court's Decree of Paternity, Custody, Visitation, and Support that was entered on or about June 1, 2023, by the Third Judicial District Court of the State of Idaho in and for the County of Canyon in case number CV14-23-02644. Aspen has had minimal contact with Billy, does not have a parent-child relationship with Billy, and it is not safe nor in Aspen's best interest to have any contact with Billy. It is not in Aspen's best interest to continue to have Billy's last name due to the horrible crimes Billy has committed. Aspen wants for her name to be changed to Aspen Rae Windsor. It is in Aspen's best interest for her name to be changed to Aspen Rae Windsor. Windsor is Jessica's mother's maiden last name, Jessica is also going to legally change her last name to Windsor, and Aspen has a great and loving relationship with Jessica's mother. A hearing on the petition is scheduled for 9:30 o'clock a.m. on 6/25/2026 with the Ada County Courthouse, via Zoom. Objections may be filed by any person who can show the court a good reason against the name change.
