Ordinance NO. ORD-8-26
BY THE COUNCIL CORLESS, HALLYBURTON, MORALES,
NASH, STEAD AND WILLITS.
AN ORDINANCE (CAR25-00009) FOR PROPERTY LOCATED AT 8430 W CASWELL ST AMENDING ZONING CLASSIFICATIONS OF THE CITY OF BOISE CITY TO CHANGE THE CLASSIFICATION OF REAL PROPERTY PARTICULARLY DESCRIBED IN SECTION 1 OF THIS ORDINANCE AND ADJACENT RIGHTS OF WAY FROM R-1A (RESIDENTIAL: LARGE LOT) TO R-2 (RESIDENTIAL: COMPACT); SETTING FORTH A REASONED STATEMENT IN SUPPORT OF SUCH ZONE CHANGE; AND PROVIDING AN EFFECTIVE DATE.
NOW THEREFORE, BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF BOISE CITY, IDAHO:
Section 1. That the land use zoning classification of the following described lands within the city of Boise City, Idaho, as set forth in Exhibits A (Map) and B (Legal Description) are amended and reclassified from R-1A (Residential: Large Lot) to R-2 (Residential: Compact), pursuant to the procedures and requirements of Idaho Code Title 67, Chapter 65 and Boise City Code Title 11, Chapter 5, and the Boise City Comprehensive Plan, as a result of changed circumstances and to promote the public health, safety, and welfare.
Section 2. Pursuant to Idaho Code § 67-6535, the Boise City Council hereby adopts the following Reasoned Statement:
Reasoned Statement
The proposed rezone from R-1A (Residential: Large Lot) to R-2 (Residential: Compact) is consistent with the approval criteria of Boise City Code (BCC) Section 11-05-05-4.I (Zoning Map Amendment). The subject area is designated as "Compact" and identified as an area of significant change, within which the R-2 zone is allowed. The proposal is compatible with the adjacent single-family residential, school, and park uses. The rezone will support additional housing within the Boise city limits, reducing vehicle miles traveled as supported by the Blueprint Boise (Policy CC1.1). The subject area is located along a collector roadway with close proximity to a best-in-class transit route, where increased density is expected. As proposed, the rezone would support a mix of housing at a density not permitted under the R-1A zone, and would be developed with pedestrian-oriented streetscapes, as encouraged by Blueprint Boise Principles GDP N.3 and GDP N.5. Lastly, the conditions of the surrounding area have changed due to the increased need for housing, as evidenced by the increased development throughout the area since the subject area was annexed in 2014. Lastly, a housing needs analysis was completed in 2021, which identified a need for housing across the city.
Section 3. The zoning maps of the city of Boise City, Idaho, are hereby changed, altered, and amended to include and insert the real property described in Exhibits A and B hereof in the land use classification herein described.
Section 4. That this Ordinance shall be in full force and effect from and after its passage, approval, and publication.
ADOPTED by the Council of Boise City, Idaho, on April 14, 2026.
APPROVED by the Mayor of the Boise City, Idaho, on April 14, 2026.
