ORD-11 -26 The undersigned, Edward Jewell, in his capacity as Deputy City Attorney of the city of Boise City, Idaho, hereby certifies that he is a legal advisor of the City and has reviewed a copy of the attached Summary of Ordinance No. ORD-11-26 of the City of Boise City, Idaho, and has found the same to be true and complete and provides adequate notice to the public pursuant to Idaho Code § 50-901A(3). ORD-11-26 OF THE CITY OF BOISE CITY, IDAHO PUBLIC NOTICE IS HEREBY GIVEN that the city of Boise City, Idaho, adopted at its regular meeting of April 14, 2026, that Ordinance No. ORD-11-26 entitled: AN ORDINANCE (ZOA25-00013) AMENDING TITLE 11, BOISE CITY CODE (DEVELOPMENT CODE); REMOVING ELECTRIC VEHICLE PARKING REQUIREMENTS AND MODIFYING BIKE PARKING REQUIREMENTS IN TITLE 11, CHAPTER 4, SECTION 8; UPDATING REQUIREMENTS FOR ACCESSORY DWELLING UNITS AND TINY HOMES ON WHEELS IN TITLE 11, CHAPTER 3, SECTION 3; MODIFYING INCENTIVES IN TITLE 11, CHAPTER 4, SECTION 3; MODIFYING THE DEFINITION OF DWELLING IN TITLE 11, CHAPTER 6, SECTION 3 TO ALLOW A SECOND KITCHEN; MODIFYING THE AIRPORT INFLUENCE AREA AND WILDLAND URBAN INTERFACE OVERLAYS IN TITLE 11, CHAPTER 7, SECTION 2; MODIFYING THE APPLICATION OF STREETSCAPE STANDARDS IN TITLE 11, CHAPTER 2; MAKING AMENDMENTS TO CORRECT ERRORS, ALIGN LANGUAGE, CLARIFY PROCEDURES, AND EASE ADMINISTRATION OF THE CODE THROUGHOUT TITLE 11; APPROVING A SUMMARY OF THE ORDINANCE; ADOPTING A REASONED STATEMENT; AND PROVIDING AN EFFECTIVE DATE. ZOA25-00013 continues the city's efforts to improve and refine Title 11 of Boise City Code (the "Boise Zoning Code" or "Development Code"). This update makes significant changes to Development Code requirements applicable to electric vehicle charging infrastructure, bicycle parking, accessory dwelling units, tiny homes on wheels, housing incentives for affordability and sustainability, and the airport influence area. In addition, this update amends sections of the Development Code related to streetscape improvements, the wildland urban interface, office use in industrial zones, attached single-family dwellings in the R-2 and MX-3 zones, cottage villages, existing developments in mixed use zones, medium retail sales in the MX-1 zone, indoor recreation in the light industrial zone, retail sales as an accessory use for urban farms in open lands zoning districts, record of survey and subdivision parcel line requirements, property line adjustments, bird friendly glass requirements, pedestrian connections, landscape buffers, Design Review Commission authority, reconsideration procedures, zoning compliance review standards, Design Review Minor purview, reasonable accommodations, reclassification of historic resources, condominium plats, legal nonconforming standards, second kitchens in single-family dwellings, and updates definitions of mixed-use, public nuisance, indoor recreation, and setbacks. Further, this amendment makes technical edits intended to fix errors and ease administration of the Boise Zoning Code by fixing inaccurate cross-references, typos, inconsistencies, aligning language between sections, and other edits to clarify and improve the functionality of the Development Code. The revision of the Development Code by City Council upon recommendation of the Planning and Zoning Commission is authorized by the Local Land Use Planning Act. The ordinance is effective upon publication, and the ordinance approves this ordinance summary. A copy of the full text of the Ordinance is available at the City Clerk's office, 150 North Capitol Boulevard, Boise, Idaho 83701. Examination may be requested in writing or in person during regular business hours of the City Clerk's office, from 8:00 a.m. until 5:00 p.m. pursuant to Section 50-901A(4), Idaho Code.
