ORDINANCE NO. 969 AN ORDINANCE CHANGING THE ZONING CLASSIFICATION OF THE REAL PROPERTY DESCRIBED HEREIN FROM A-R (AGRICULTURAL-RESIDENTIAL) TO R-1 (RESIDENTIAL) AND TO R-3-DA-P (RESIDENTIAL WITH A DEVELOPMENT AGREEMENT – PUD), AND; AMENDING THE ZONING MAP OF THE CITY OF EAGLE TO REFLECT SAID CHANGE; DIRECTING THAT COPIES OF THIS ORDINANCE BE FILED AS PROVIDED BY LAW; PROVIDING A SEVERABILITY CLAUSE; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the City of Eagle, Idaho is a municipal corporation organized and operating under the laws of the State of Idaho; and WHEREAS, pursuant to Chapter 65, Title 67, Idaho Code, the City of Eagle has the authority to adopt, establish, and amend a Zoning Ordinance; and WHEREAS, the owner of the real property situated within the City of Eagle and particularly described in Exhibit "A" and shown on Exhibit "B" of this ordinance has requested, in writing, a rezone from A-R (Agricultural-Residential) to R-1 (Residential); and WHEREAS, the owner of the real property situated within the City of Eagle and particularly described in Exhibit "C" and shown on Exhibit "D" of this ordinance has requested, in writing, a rezone from A-R (Agricultural-Residential) to R-3-DA-P (Residential with a development agreement – PUD); and WHEREAS, the properties described in Exhibit "A" and Exhibit "C" are identified by the Ada County Assessor's Office as tax parcel numbers R2860500034 and R2860500032 respectively; and WHEREAS, the Planning and Zoning Commission of the City, pursuant to public notice as required by law, held a public hearing on May 5, 2025, as required by Section 67-6525, Idaho Code, and made a recommendation to the Mayor and Council; and WHEREAS, the Eagle City Council, pursuant to public notice as required by law, held a public hearing on June 10, 2025, on the proposed zoning for the real properties described in Exhibit "A" and Exhibit "C" as required by Section 67-6509, Idaho Code, made findings and determined that the requested zoning classifications of R-1 (Residential) and R-3-DA-P (Residential with a development agreement – PUD) for the properties described in Exhibit "A" and Exhibit "C" respectively are appropriate to meet the requirements of Idaho Code, Eagle City Code and the Eagle Comprehensive Plan and is hereby granted. NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF EAGLE, IDAHO, as follows: Section 1: The Eagle City Council hereby finds and declares that the real property particularly described in Exhibit "A" and shown on Exhibit "B" be removed from the A-R (Agricultural-Residential) zoning classification and included in the R-1 (Residential) zoning classification, and the real property particularly described in Exhibit "C" and shown on Exhibit "D" be removed from the A-R (Agricultural-Residential) zoning classification and included in the R-3-DA-P (Residential with a development agreement – PUD) zoning classification pursuant to the Zoning Ordinance of the City of Eagle. The City Council further finds and determines that said zone changes are in accordance with the Eagle Comprehensive Plan and relevant City Codes. Section 2: The real property, all situated in the City of Eagle, Ada County, Idaho, particularly described in Exhibit "A" and as generally shown on Exhibit "B", is hereby removed from the A-R (Agricultural-Residential) zoning classification and is hereby included in the R-1 (Residential) zoning classification. Section 3: The real property, all situated in the City of Eagle, Ada County, Idaho, particularly described in Exhibit "C" and as generally shown on Exhibit "D", is hereby removed from the A-R (Agricultural-Residential) zoning classification and is hereby included in the R-3-DA-P (Residential with a development agreement – PUD) zoning classification. Section 4: The official Zoning Map of the City of Eagle, Idaho, is hereby amended to reflect the foregoing changes in zoning classification. Section 5: The provisions of this ordinance are hereby declared to be severable and if any provision of this act or the application of such provision to any person or circumstance is declared invalid for any reason, such declaration shall not affect the validity of remaining portions of this ordinance. Section 6: This ordinance shall take effect and be in force from and after its passage, approval, and one (1) publication of the ordinance in the official newspaper of the City. Osborn, Eagle City Clerk Exhibit A Legal Description Whitehurst Village Subdivision A parcel being located in the SE 1/4 of Section 12, Township 4 North, Range 1 West, Boise Meridian, City of Eagle, Ada County, Idaho, and more particularly described as follows: Commencing at an Aluminum Cap monument marking the northwest corner of the SE 1/4 (Center ¼ corner) of said Section 12, from which an Aluminum Cap monument marking the northeast corner of said SE 1/4 bears S 89°20'20" E a distance of 2644.73 feet; Thence S 89°20'20" E along the northerly boundary of said SE 1/4 a distance of 1326.42 feet to a point; Thence leaving said boundary S 0°43'04" W a distance of 236.53 feet to the POINT OF BEGINNING; Thence continuing S 0°43'04" W a distance of 239.04 feet to a point on the centerline of W. Flint Drive; Thence along said centerline S 79°40'36" W a distance of 264.51 feet to a point; Thence leaving said centerline N 0°43'04" E a distance of 289.68 feet to a point; Thence S 89°17'06" E a distance of 259.61 feet to the POINT OF BEGINNING.
