ORD-5-26 The undersigned, Jennifer Pitino, in her capacity as Deputy City Attorney of the city of Boise City, Idaho, hereby certifies that she is a legal advisor of the City and has reviewed a copy of the attached Summary of Ordinance No. ORD-5-26 of the City of Boise City, Idaho, and has found the same to be true and complete and provides adequate notice to the public pursuant to Idaho Code § 50-901A(3). ORD-5-26 OF THE CITY OF BOISE CITY, IDAHO PUBLIC NOTICE IS HEREBY GIVEN that the city of Boise City, Idaho, adopted at its regular meeting of March 10th, 2026, that Ordinance No. ORD-5-26 entitled: AN ORDINANCE AMENDING BOISE CITY CODE ("BCC") TITLE 1, CHAPTER 14, TO RENAME THE CHAPTER "CITY RECORDS AND ARCHIVES"; AMENDING EXISTING DEFINITION AND ADD NEW DEFINITIONS; ADDING REFERENCES TO HISTORIC RECORDS AND ARTIFACTS THROUGHOUT THE CHAPTER; ESTABLISHING THE CITY ARCHIVES; CLARIFYING THE ROLE AND RESPONSIBILITIES OF THE CITY CLERK REGARDING RECORDS MANAGEMENT AND RELATED DUTIES; CLARIFYING THE ROLE AND RESPONSIBILITIES OF THE CITY ARCHIVIST REGARDING THE CITY ARCHIVES; PROVIDING THE RESPONSIBILITIES OF CITY DEPARTMENT HEADS, DEPARTMENT RECORDS COORDINATORS, AND ALL CITY EMPLOYEES AND OFFICIALS REGARDING CITY RECORDS; SETTING FORTH GENERAL RECORDS REQUIREMENTS FOR ALL CITY OFFICIALS AND EMPLOYEES; CLARIFYING THE STORAGE, MAINTENANCE, AND MANAGEMENT OF CITY RECORDS AND ARCHIVES; SIMPLIFYING STANDARDS REGARDING PHOTOGRAPHIC AND DIGITAL RECORDS; SETTING FORTH CLEARER LANGUAGE REGARDING ACCESS TO CITY RECORDS FOR INSPECTION AND COPYING AND THE ASSOCIATED FEES; REMOVING REDUNDANT LANGUAGE THAT RESTATES PROVISIONS OF THE IDAHO PUBLIC ACT OR ARE OTHERWISE UNNECESSARY OR MOVED TO DIFFERENT CODE SECTIONS WITHIN THE CHAPTER BY REPEALING AND STRIKING FROM CODE THE FOLLOWING SECTIONS BCC SECTION 1-14-3 ENTITLED "POLICY," BCC SECTION 1-14-8 ENTITLED "CITY OFFICES TO USE RECORDS SCHEDULES," BCC SECTION 1-14-10 ENTITLED "ONE TIME DESTRUCTION OF OBSOLETE RECORDS," BCC SECTION 1-14-11 ENTITLED "ARCHIVES," BCC SECTION 1-14-12 ENTITLED "PRESERVATION OF PERMANENT RECORDS," BCC SECTION 1-14-13 ENTITLED "NONCURRENT RECORDS NOT TO BE MAINTAINED IN OFFICE FILES," BCC SECTION 1-14-15 ENTITLED "ACCESSIBILITY OF RECORDS ON MICROFILM OR DIGITAL MEDIA," BCC SECTION 1-14-16 ENTITLED PUBLIC DISCLOSURE OF LICENSING RECORDS"; RENUMBERING THE SUBSEQUENT CODE SECTIONS ACCORDINGLY; APPROVING A SUMMARY OF THE ORDINANCE; AND PROVIDING AN EFFECTIVE DATE. This ordinance amends Boise City Code "BCC" Title 1, Chapter 14, to rename the chapter "City Records and Archives." The ordinance amends an existing definition and adds new ones. It adds references to historic records and artifacts throughout the chapter. The ordinance establishes the City archives. This ordinance clarifies the City Clerk's role and responsibilities regarding records management and as the Municipal Records Manager. The ordinance establishes the City Archivist's role and responsibilities regarding the archives. It also sets forth the responsibilities of the City department heads, the Department Records Coordinators, and all City employees and officials regarding City records. The ordinance provides general records requirements for all City employees and officials. It clarifies the storage, maintenance, and management of City records and archives. This ordinance simplifies standards regarding photographic and digital records. The ordinance provides plainer and clearer language regarding the access to City records for inspection and copying and the associated fees. It removes redundant code sections that restate provisions of the Idaho Public Records Act, or that are otherwise unnecessary or have been moved to different subsections of the chapter, by repealing and striking from the code several sections. Thus, it repeals and strikes from code the following: BCC Section 1-14-3 entitled "Policy," BCC Section 1-14-8 entitled "City Offices to Use Records Schedules," BCC Section 1-14-10 entitled "One Time Destruction of Obsolete Records," BCC Section 1-14-11 entitled "Archives," BCC Section 1-14-12 entitled "Preservation of Permanent Records," BCC Section 1-14-13 entitled "Noncurrent Records Not to Be Maintained in Office Files," BCC Section 1-14-15 entitled "Accessibility of Records on Microfilm or Digital Media," and BCC Section 1-14-16 entitled "Public Disclosure of Licensing Records." This ordinance renumbers the subsequent code sections accordingly. The ordinance establishes an ordinance effective date and approves this ordinance summary. The effective date of the ordinance is the date of its passage, approval, and publication. A copy of the full text of the ordinance is available at the City Clerk's office, 150 North Capitol Boulevard, in Boise, Idaho 83701. Examination may be requested in writing or in person during regular business hours of the City Clerk's office, from 8:00 a.m. until 5:00 p.m. pursuant to Idaho Code Title 50, Chapter 9, Section 01A(4).
