AN ORDINANCE (CAR25-00018) FOR PROPERTY LOCATED AT 2911 N FIVE MILE ROAD AMENDING ZONING CLASSIFICATIONS OF THE CITY OF BOISE CITY TO CHANGE THE CLASSIFICATION OF REAL PROPERTY PARTICULARLY DESCRIBED IN SECTION 1 OF THIS ORDINANCE AND ADJACENT RIGHTS OF WAY FROM R-1C (RESIDENTIAL: TRADITIONAL) TO R-2 (RESIDENTIAL: COMPACT); SETTING FORTH A REASONED STATEMENT IN SUPPORT OF SUCH ZONE CHANGE; AND PROVIDING AN EFFECTIVE DATE.
NOW THEREFORE, BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF BOISE CITY, IDAHO:
Section 1. That the land use zoning classification of the following described lands within the city of Boise City, Idaho, as set forth in Exhibits A (Legal Description) and B (Map) are amended and reclassified from R-1C (Residential: Traditional) to R-2 (Residential: Compact), pursuant to the procedures and requirements of Idaho Code Title 67, Chapter 65 and Boise City Code Title 11, Chapter 5, and the Boise City Comprehensive Plan, as a result of changed circumstances and to promote the public health, safety, and welfare.
Section 2. Pursuant to Idaho Code § 67-6535, the Boise City Council hereby adopts the following Reasoned Statement:
Reasoned Statement
The proposed rezone from R-1C (Residential: Traditional) to R-2 (Residential: Compact) is consistent with the approval criteria of Boise City Code (BCC) Section 11-05-05.4.I (Zoning Map Amendment). The rezone to R-2 is consistent with the surrounding area, which consists of single-family detached homes, a public park, and multi-family. The R-2 zone is compatible with the size, scale, height, density, and mobility networks of the surrounding area. The site is located within a Neighborhood Activity Center and is 800 feet south of a bus stop. Comba Park abuts the property to the north, providing a mix of uses and open space within walking distance of the subject property. Rezoning areas for higher density where existing infrastructure exists is strategic as the population of Boise continues to grow. Due to its location, the Mixed-Use Land Use Designation anticipates the R-2 zone, and the multi-family use is an allowed use within the R-2 zone. The R-2 zone requires neighborhood transitional standards in order to identify and mitigate any potential adverse impacts to adjacent R-1C zoning. Any proposed development will improve pedestrian facilities along Five Mile Road by providing the required streetscape requirements. The proposed rezone to R-2 is consistent with Blueprint Boise. By rezoning to R-2, the subject property aligns with Policies ES1.4 and NAC7.1, along with Principles GDP-N.3 and WB-CCN1.1 which promote compact, infill development with a mixture of housing. Additionally, Policy NAC3.1, Policy CC1.1, and Goal WB-CCN2.2 support density to reduce vehicle miles traveled. Finally, any redevelopment of the site will improve pedestrian comfort along Five Mile Road which is aligned with Policy CC7.1, Policy CC7.2, Principle GDP-N.5, and Goal WB-C2.2.
Section 3 The zoning maps of the city of Boise City, Idaho, are hereby changed, altered, and amended for the real property described in Exhibit A and depicted in Exhibit B in the land use classification herein described.
Section 4. That this Ordinance shall be in full force and effect from and after its passage, approval, and publication.
