ORD-7-26 OF THE CITY OF BOISE CITY, IDAHO PUBLIC NOTICE IS HEREBY GIVEN that the city of Boise City, Idaho, adopted at its regular meeting of March 3, 2026, that Ordinance No. ORD-7-26 entitled: AN ORDINANCE GRANTING TO INTERMOUNTAIN GAS COMPANY, AN IDAHO CORPORATION, ITS SUCCESSORS AND ASSIGNS, AN EXCLUSIVE FRANCHISE FOR ITS GAS UTILITY WITHIN BOISE, SUCH UTILITY DEFINED AS THE CONSTRUCTION, INSTALLATION, IMPROVEMENT, EXTENSION, MAINTENANCE AND OPERATION, REMOVAL OR ABANDONMENT IN PLACE OF THE NATURAL GAS TRANSMISSION AND DISTRIBUTION SYSTEM TO FURNISH, TRANSMIT, DISTRIBUTE, AND SELL GAS, WHETHER ARTIFICIAL OR NATURAL, MIXED OR OTHERWISE FOR HEATING, DOMESTIC, INDUSTRIAL AND OTHER PURPOSES; APPROVING THE FRANCHISE AGREEMENT THAT PROVIDES THE TERMS AND CONDITIONS OF SUCH FRANCHISE; PROVIDING FOR A WAIVER OF THE READING RULES; APPROVING A SUMMARY OF THE ORDINANCE; AND PROVIDING AN EFFECTIVE DATE. The City of Boise has a franchise agreement with Intermountain Gas Company (Intermountain Gas) for the operation of its Gas Utility in Boise. The current 20-year franchise was set to expire on January 9, 2026. The term was extended to March 9, 2026. This ordinance adopts an updated Franchise Agreement (Agreement) for a new 20-year term. The Agreement maintains provisions regarding: the use of streets, roads, alleys, bridges and public ways and places within Boise, subject to rules governing the same (such as location, relocation, and construction); the rights of inspection of records; the franchise fee percentage of 3% of gross revenues from sales in Boise and collection and payment to the City; the obligation of the City to provide notice regarding annexations; indemnification and insurance; and the agreement not to compete. The Agreement updates the structure and organization of the terms and conditions, and adds/updates the following provisions: adding definitions; the scope of the franchise; limitations on the use of certain public ways and places owned by the City; coordination for emergency response; defining default, remedies, forfeiture, and surrender. This Ordinance and the Agreement are in accordance with Idaho Code 50-328, 50-329, and 50-329A. Intermountain Gas must provide written acceptance of this Ordinance and the Agreement within 30 days after passage and publication. The ordinance provides for a waiver of the reading rules, approves this ordinance summary, and establishes the effective date of March 9, 2026, upon its passage, approval, publication and acceptance.
