ORDINANCE NO. 961 AN ORDINANCE OF THE CITY OF EAGLE, ADA COUNTY IDAHO, AMENDING TITLE 8, CHAPTER 1, SECTION 2, “RULES AND DEFINITIONS”; CHAPTER 2, SECTION 3, “SCHEDULE OF DISTRICT REGULATIONS”, CHAPTER 3, SECTION 5, “UNIQUE LAND USES”; PROVIDING A SEVERABILITY CLAUSE; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the City of Eagle, Idaho is a municipal corporation organized and operating under the laws of the State of Idaho; and WHEREAS, pursuant to Chapter 65, Title 67, Idaho Code, the City of Eagle has the authority to adopt, establish and amend a Zoning Ordinance; and WHEREAS, the Mayor and Council have determined that good cause exists for amending the Eagle City Zoning Code to protect the public health and safety and the aesthetic quality of the City; and WHEREAS, the proposed changes to the Eagle Zoning Code is in accordance with the City of Eagle Comprehensive Plan; NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF EAGLE, Ada County, Idaho; Section 1: That Title 8, Chapter 1, Section 2, be and is hereby amended, to read as follows with underline text to be added and strikethrough text to be removed: 8-1-2: RULES AND DEFINITIONS: VETERINARY ANIMAL CLINIC: A place which operates for no more than 12-hours per day and is used for the care, grooming, diagnosis and treatment of sick, ailing, infirm or injured animals, and animals who are in need of medical or surgical attention. Overnight accommodations for supplementary treatment, observation and/or recuperation for animals treated during operating hours may occur. No animal activities are permissible outdoors except for necessary bathroom-related activities. VETERINARY ANIMAL HOSPITAL OR CLINIC: A place which may operate for up to 24-hours per day and is used for the care, grooming, diagnosis and treatment of sick, ailing, infirm or injured animals, and those animals who are in need of medical or surgical attention and may include overnight accommodations on the premises for treatment, observation and/or recuperation. It may also include boarding that is incidental to the primary activity. or 24- hour operations. Section 2: That Title 8, Chapter 2, Section 3, be and is hereby amended, to read as follows with underline text to be added: 8-2-3: SCHEDULE OF DISTRICT REGULATIONS: OFFICIAL SCHEDULE OF DISTRICT REGULATIONS (P – Permitted Use / C – Conditional Use / No P or C – Prohibited Use) DISTRICTS LAND USES A A-R R-E R L-O C-A C-1 C-2 C-3 CBD M-1 BP M-2 M-3 PS MU COMMERCIAL: Veterinary Animal Clinic C C C P P P C P Vet clinic (animal hospital) C C C P C P C P C P C P C Veterinary Animal Hospital Section 3: That Title 8, Chapter 3, Section 5, to read as follows with underline text to be added and removed the stricken text: 8-3-5: UNIQUE LAND USES: C. Animal Clinic, Veterinary Animal Hospital, Veterinary Office And Kennel: 1. Will be located at least five hundred feet (500’) from any residence including motels and hotels, except for an owner’s residence. The Administrator may modify these requirements if the animals are completely housed in soundproof structures that completely screen them from view of the abutting residential property; and 2. Will comply with all State and local regulations relative to such an operation and maintain adequate housekeeping practices designed to prevent the creation of a nuisance and to reduce to a minimum the factors of noise and odor. Section 4: The provisions of this ordinance are hereby declared to be severable and if any provision of this act or the application of such provision to any person or circumstance is declared invalid for any reason, such declaration shall not affect the validity of remaining portions of this ordinance. Section 5: This ordinance shall take effect and be in force from and after its passage, approval, and publication as required by law. In lieu of publication of the entire ordinance, a summary thereof in compliance with Section 50-901A, Idaho Code, may be published. Approved and adopted this 10th day of February 2026.
