This ordinance repeals the existing Boise City Code ("BCC") Title 3, Chapter 1, Article A, striking it from the code, and replacing it with a newly enacted BCC Title 3, Chapter 1, Article A, entitled "Business Licenses Generally." The ordinance sets forth the legal authority, purpose, and scope of this article. It provides a definition section that includes new and amended terms from the repealed article. This ordinance requires licensing to operate certain businesses within the City and limits the transferability of such licenses. The ordinance provides the manner, form, and required information for all license applications, the timing and fees for such applications, and sets forth an ongoing duty to update such information as necessary. It provides the license term and renewal, and allows a license to remain valid during the renewal application investigation. This ordinance provides for the disposition of license applications, including the review and investigation, and termination of incomplete applications after 60 days. The ordinance provides for background checks for adults and juveniles. It sets forth the potential consequences for failing to disclose required application information or failing to update a material change to such information. This ordinance provides the disqualifying crimes or circumstances for Tier 1, 2, and 3 licenses and driving businesses. It provides a process for applicants to seek a license exemption review. This ordinance provides for notice of the City's inability to proceed with an application. It provides for the notice of license violations. The ordinance requires the licensee's consent for reasonable compliance inspections. This ordinance provides for notice of license denial, revocation, or suspension. It sets forth the reasons for denial, suspension, or revocation of a license. The ordinance provides for the stay of a license suspension or revocation, as well as the emergency suspension or revocation of a license. This ordinance establishes a relicensure waiting period following license revocation. The ordinance provides applicants a process for an informal review of license denials, suspensions, or revocations. It sets forth a process for a director's review of an informal review decision. It also sets forth the authority and process for a hearing officer's review of a director's review decision. This ordinance provides general responsibilities of licensees. It sets forth the penalties for violations of this article. The ordinance establishes an ordinance effective date and approves this ordinance summary. The effective date of the ordinance is the date of its passage, approval and publication. A copy of the full text of the ordinance is available at the City Clerk's office, 150 North Capitol Boulevard, in Boise, Idaho 83701. Examination may be requested in writing or in person during regular business hours of the City Clerk's office, from 8:00 a.m. until 5:00 p.m. pursuant to Idaho Code Title 50, Chapter 9, Section 01A(4).
