AN ORDINANCE (CAR25-00013) FOR PROPERTY LOCATED AT 1312, 1328, & 1334 E LEWIS STREET, BOISE, ID 83712 AMENDING ZONING CLASSIFICATIONS OF THE CITY OF BOISE CITY TO CHANGE THE CLASSIFICATION OF REAL PROPERTY PARTICULARLY DESCRIBED IN SECTION 1 OF THIS ORDINANCE AND ADJACENT RIGHTS OF WAY FROM R-1C/HD-O (RESIDENTIAL: TRADITIONAL WITH HISTORIC DESIGN OVERLAY) TO R-1C (RESIDENTIAL: TRADITIONAL); SETTING FORTH A REASONED STATEMENT IN SUPPORT OF SUCH ZONE CHANGE; AND PROVIDING AN EFFECTIVE DATE.
NOW THEREFORE, BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF BOISE CITY, IDAHO:
Section 1. That the land use zoning classification of the following described lands within the city of Boise City, Idaho, as set forth in Exhibits A (Legal Description) and B (Map) are amended and reclassified from R-1C/HD-O (Residential: Traditional with Historic Design Overlay) to R-1C (Residential: Traditional), pursuant to the procedures and requirements of Idaho Code Title 67, Chapter 65 and Boise City Code Title 11, Chapter 5, and the Boise City Comprehensive Plan, as a result of changed circumstances and to promote the public health, safety, and welfare.
Section 2. Pursuant to Idaho Code § 67-6535, the Boise City Council hereby adopts the following Reasoned Statement:
Reasoned Statement
The zoning map amendment to remove the "HD-O" (Historic Design Overlay) is consistent with the approval criteria of Boise City Code (BCC) Section 11-05-05.4.I. (Zoning Map Amendment). The removal of the overlay is consistent with its surroundings, the majority of which are not included within the overlay. The Warm Springs Avenue Historic District was established by a rezone application (RZ-12-95), which added the overlay to all properties that were oriented towards Warm Springs Avenue, from Broadway Avenue to the west to Mobley Avenue to the east, totaling approximately 70 acres. This rezone was intended to apply to properties that contained the following characteristics: oriented towards and accessed from Warm Springs Avenue, containing structure(s) with a distinct architectural style, and access to geothermal lines. The subject properties have been subdivided from the rear yard of the originally rezoned property and are no longer accessed from Warm Springs Avenue, currently vacant, and do not have access to a geothermal line. As such, the subject properties do not contain these characteristics that define the historical context of this neighborhood and therefore are not pertinent to the historic district. Thus, the rezone is needed to accommodate this change in the subject properties. The proposed amendment is in the best interest of the public convenience and general welfare because these properties do not contain the characteristics which define the Historic Overlay and therefore do not contribute to the historical context of the neighborhood. The size, scale, height, density, and mobility of the initial zoning is compatible with surrounding development as the R-1C base zoning designation is unchanged by the requested zoning map amendment. The amendment is supported by Blueprint Boise, which encourages the designation, maintenance of inventory, and periodic update of historic places based on sites' compliance with the statutory requirements of the goals policies of the Historic Preservation Plan (Policies NAC13.1, NAC13.2, and NAC13.3).
Section 3. The zoning maps of the city of Boise City, Idaho, are hereby changed, altered, and amended to include and insert the real property described in Exhibits A and B hereof in the land use classification therein described.
Section 4. That this Ordinance shall be in full force and effect from and after its passage, approval, and publication.
