Ordinance NO. ORD-46-25 BY THE COUNCIL CORLESS, HALLYBURTON, MORALES, NASH, STEAD AND WILLITS. AN ORDINANCE (CAR25-00016) FOR PROPERTY LOCATED AT 2653 S VICTORY VIEW WAY AMENDING ZONING CLASSIFICATIONS OF THE CITY OF BOISE CITY TO CHANGE THE CLASSIFICATION OF REAL PROPERTY PARTICULARLY DESCRIBED IN SECTION 1 OF THIS ORDINANCE AND ADJACENT RIGHTS OF WAY FROM R-1A (RESIDENTIAL: LARGE LOT) TO I-1 (LIGHT INDUSTRIAL); SETTING FORTH A REASONED STATEMENT IN SUPPORT OF SUCH ZONE CHANGE; AND PROVIDING AN EFFECTIVE DATE. NOW THEREFORE, BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF BOISE CITY, IDAHO: Section 1. That the land use zoning classification of the following described lands within the city of Boise City, Idaho, as set forth in Exhibits A (Legal Description) and B (Map) are amended and reclassified from R-1A (Residential: Large Lot) to I-1 (Light Industrial), pursuant to the procedures and requirements of Idaho Code Title 67, Chapter 65 and Boise City Code Title 11, Chapter 5, and the Boise City Comprehensive Plan, as a result of changed circumstances and to promote the public health, safety, and welfare. Section 2. The lands described in Section 1 hereof are subject to the Airport Influence Area and Floodplain Protection Sensitive Lands Overlay Districts and the standards in Boise City Code Title 11, Chapter 2, Section 7 as modified from time to time by Boise City ordinance. Section 3. Pursuant to Idaho Code § 67-6535, the Boise City Council hereby adopts the following Reasoned Statement: Reasoned Statement The proposed rezone from R-1A/AI-O/FP-O (Residential: Large Lot with Airport Influence Area Overlay and Flood Protection Overlay) to I-1/AI-O/FP-O (Industrial: Light with Airport Influence Area Overlay and Flood Protection Overlay) is consistent with the approval criteria of Boise City Code (BCC) Section 11-05-05-4.I (Zoning Map Amendment). Five Mile Creek is located along the east side of the property, and it creates a natural barrier between the adjacent residential neighborhood and the subject property, which is very difficult to cross. As such, rezoning the 4.17-acre eastern portion of the subject property from R-1A to I-1 will allow the area to the west of Five Mile Creek to be developed as a cohesive industrial development with access through the industrial neighborhood. In addition, the rezone from R-1A to I-1 will protect the industrial area from encroachment by incompatible uses (i.e., residential) that could threaten its ability to operate and it would remove a spit zoned parcel. Therefore, the proposed rezone is required to correct a technical error of the zoning map, and it is in the best interest of the community. In addition, developing the 4.17-acre portion of the site as residential under the existing R-1A zone is not feasible since the site only has access through the adjacent industrial area. The proposal is compatible with the surrounding industrial area in terms of size, scale, height, and density. The rezone would allow the existing data center on-site to expand and grow. The comprehensive plan encourages the creation of a business-friendly environment that promotes the retention and growth of existing businesses (Policy EC 3.1). In addition, light industrial uses are anticipated within this area of southwest Boise (Policy SW-CCN 1.5). Section 4. The zoning maps of the city of Boise City, Idaho, are hereby changed, altered, and amended to include and insert the real property described in Exhibits A and B hereof in the land use classification therein described. Section 5. That this Ordinance shall be in full force and effect from and after its passage, approval, and publication. ADOPTED by the Council of Boise City, Idaho, on January 27, 2026.
