Ordinance NO. ORD-45-25 BY THE COUNCIL CORLESS, HALLYBURTON, MORALES, NASH, STEAD AND WILLITS. AN ORDINANCE (CAR25-00006) FOR PROPERTY LOCATED AT 11076 W ARCH STREET AMENDING ZONING CLASSIFICATIONS OF THE CITY OF BOISE CITY TO CHANGE THE CLASSIFICATION OF REAL PROPERTY PARTICULARLY DESCRIBED IN SECTION 1 OF THIS ORDINANCE AND ADJACENT RIGHTS OF WAY FROM R-1C (RESIDENTIAL: TRADITIONAL) TO MX-1 (MIXED USE: NEIGHBORHOOD); SETTING FORTH A REASONED STATEMENT IN SUPPORT OF SUCH ZONE CHANGE; AND PROVIDING AN EFFECTIVE DATE. NOW THEREFORE, BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF BOISE CITY, IDAHO: Section 1. That the land use zoning classification of the following described lands within the city of Boise City, Idaho, as set forth in Exhibits A (Map) and B (Legal Description) are amended and reclassified from R-1C (Residential: Traditional) to MX-1 (Mixed Use: Neighborhood), pursuant to the procedures and requirements of Idaho Code Title 67, Chapter 65 and Boise City Code Title 11, Chapter 5, and the Boise City Comprehensive Plan, as a result of changed circumstances and to promote the public health, safety, and welfare. Section 2. Pursuant to Idaho Code § 67-6535, the Boise City Council hereby adopts the following Reasoned Statement: Reasoned Statement The proposed rezone from R-1C (Residential: Traditional) to MX-1 (Mixed Use: Neighborhood) is consistent with the approval criteria of Boise City Code (BCC) Section 11-05-05-4.I. (Zoning Map Amendment). The subject property is designated as "Mixed Use," within which the MX-1 zone is allowed. The proposal is compatible with the adjacent residential neighborhoods and the commercial uses along Ustick Road and provides additional housing within the Boise City limits. The amendment is needed to correct a technical error in the current zoning map in that the proposed MX-1 zone supports a higher density infill development with a mixture of housing types along an arterial roadway and infill development, which is promoted by the comprehensive plan (Policies NAC3.1, and NAC7.1). The site is located along an arterial roadway (Ustick Road) with public transit and within 660 feet of the Ustick Town Site. Mixed-use and residential developments are encouraged along Ustick Road and near the Ustick Town Site (Policy WB-CCN1.3 and Policy WB-CCN1.4). In addition, the West Valley Community Center Plan encourages a mix of both residential and commercial developments around the original Ustick Town Site plat (Objective 2.3.2). The rezone to MX-1 will support the type of mixed-use development anticipated in this area. The proposed rezone is in the best interest of the public as it will provide additional housing along an arterial roadway near existing services within an area where higher density residential developments are anticipated. Section 3. The zoning maps of the city of Boise City, Idaho, are hereby changed, altered, and amended to include and insert the real property described in Exhibits A and B hereof in the land use classification herein described. Section 4. That this Ordinance shall be in full force and effect from and after its passage, approval, and publication. ADOPTED by the Council of Boise City, Idaho, on January 27, 2026.
