BY THE COUNCIL CORLESS, HALLYBURTON, MORALES,
NASH, STEAD AND WILLITS.
AN ORDINANCE REPEALING AND STRIKING SUBSECTION (D) FROM TITLE 6, CHAPTER 2, SECTION 2 FROM THE BOISE CITY CODE AND RENUMBERING THE SUBSEQUENT SUBSECTION ACCORDINGLY; PROVIDING FOR A WAIVER OF THE READING RULES; AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, in 2016 the city of Boise City ("City") established its Transportation Action Plan, which included adopting a Vision Zero (i.e., a nationwide initiative to eliminate traffic fatalities and serious injuries) framework, and in 2021 the City created a Vision Zero Taskforce to help the City develop an action plan to reduce serious injuries and deaths on our streets; and,
WHEREAS, thus far this year, there have been ninety-six (96) serious traffic-related injuries and seven (7) traffic-related fatalities in the City; and,
WHEREAS, in response, the Ada County Highway District ("ACHD") has reduced the speed limits on several streets in the City, including most recently, lowering the speed limits to twenty (20) miles per hour on Ninth Street, Fifteenth Street, and Harrison Boulevard to improve public safety on those residential main roadways; and,
WHEREAS, Boise City Code ("BCC") Section 6-6-2 (E) sets the default speed on all City streets not otherwise posted or controlled by code at a maximum speed limit of twenty miles per hour; and,
WHEREAS, BCC Section 6-6-2 (E) sets a default speed limit of thirty (30) miles per hour on through streets (as defined in BCC Section 6-1-1) that have posted "Stop" or "Yield" signs; and,
WHEREAS, the City believes that repealing BCC Section 6-6-2(D), thereby eliminating the thirty (30) mile per hour default speed on through streets, would promote greater consistency across the municipal street network and only applies to streets that are unsigned, and align with ACHD's recent speed reductions and the Vision Zero mission.
BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF BOISE CITY, IDAHO:
Section 1. That existing Boise City Code Title 6, Chapter 2, Section 2, Subsection D shall be, and hereby is, repealed and stricken from Boise City Code, with subsequent subsections renumbered accordingly.
D. Thirty (30) miles per hour upon through streets when "Stop" or "Yield" signs are in place.
Section 2. That pursuant to the affirmative vote of one-half (1/2) plus one (1) of the members of the full Council, the rule requiring two (2) separate readings by title and one (1) reading in full be, and the same is hereby, dispensed with accordingly. This Ordinance shall be in full force and effect upon its passage, approval, and publication.
