AN ORDINANCE (CAR25-00012) FOR PROPERTY LOCATED AT 2705 & 2709 N COLE ROAD, BOISE, ID 83704 AMENDING ZONING CLASSIFICATIONS OF THE CITY OF BOISE CITY TO CHANGE THE CLASSIFICATION OF REAL PROPERTY PARTICULARLY DESCRIBED IN SECTION 1 OF THIS ORDINANCE AND ADJACENT RIGHTS OF WAY FROM R-1C (RESIDENTIAL: TRADITIONAL) TO R-2 (RESIDENTIAL: COMPACT); SETTING FORTH A REASONED STATEMENT IN SUPPORT OF SUCH ZONE CHANGE; AND PROVIDING AN EFFECTIVE DATE.
NOW THEREFORE, BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF BOISE CITY, IDAHO:
Section 1. That the land use zoning classification of the following described lands within the city of Boise City, Idaho, as set forth in Exhibits A (Legal Description) and B (Map) are amended and reclassified from R-1C (Residential: Traditional) to R-2 (Residential: Compact), pursuant to the procedures and requirements of Idaho Code Title 67, Chapter 65 and Boise City Code Title 11, Chapter 5, and the Boise City Comprehensive Plan, as a result of changed circumstances and to promote the public health, safety, and welfare.
Section 2. Pursuant to Idaho Code § 67-6535, the Boise City Council hereby adopts the following Reasoned Statement:
Reasoned Statement
The rezone from R-1C (Residential: Traditional) to R-2 (Residential: Compact) is consistent with the approval criteria of Boise City Code (BCC) Section 11-05-05.4.I. (Zoning Map Amendment). The rezone to R-2 is consistent with the surrounding area, which is comprised of a mix of residential uses, with multi-family developments zoned R-2 adjacent to the west, south, and southeast, and detached single-family dwellings adjacent to the north and northeast, zoned R-1C. The Future Land Use Map designates this area as "Mixed-Use" within which, the R-2 zone is allowed. The amendment is needed to address a changed condition in the area, in that, the neighborhood has been identified as a "Level 1 Area of Change" within Blueprint Boise, meaning significant new and re-development are expected. These areas are typically categorized by criteria based on location, such as along a transit route, other redevelopments, constructions, or relocation of major uses occurring within close proximity, all of which are present in this case. The subject property is located along a bus route, surrounded by a mix of residential, and borders multi-family developments to its west, south, and southeast. Thus, this location is appropriate for infill densification under the R-2 zone. Directing higher density zoning designations in Level 1 Areas of Change is in the best interest of the public convenience and general welfare, by minimizing impacts to surrounding uses while providing opportunities for new residents to meet daily needs without a heavy reliance on single-occupancy vehicles, which also aligns with the City's climate goals. A proposed redevelopment of the site will be subject to design review, which will apply neighborhood transition standards along the northern side of the property line, that borders the R-1C zone. The design review process will limit building heights and the location of parking to further ensure that the redevelopment is compatible with its surroundings. Therefore, the R-2 zone is compatible with the size, scale, height, density, and mobility network of the surrounding area. The rezone is in the best interest of the public convenience and general welfare as it will allow the an infill redevelopment of a site along an arterial roadway with a bus route, within a "Level 1 Area of Change", where significant new and redevelopment is anticipated, as encouraged by Blueprint Boise's Goal WB-CCN 1, Principles GDP-MU.1, GDP-MU.2, and GDP-MU.6, and Policies PDP1.1 and NAC3.2. Finally, the development code requires all new development within the R-2 zone and adjacent to an arterial roadway to improve the mobility network by constructing 10-foot-wide detached sidewalks with street trees as supported by Principles GDP-N.5 and IDP-N.2, and Goal WB-C 2.
Section 3. The zoning maps of the city of Boise City, Idaho, are hereby changed, altered, and amended to include and insert the real property described in Exhibits A and B hereof in the land use classification therein described.
Section 4. That this Ordinance shall be in full force and effect from and after its passage, approval, and publication.
