PUBLIC NOTICE OF APPLICATION
FOR COASTAL WETLANDS PERMIT
AND WATER QUALITY CERTIFICATION
Pavco Industries Inc has filed an application with the Department of Marine Resources requesting permission to conduct regulated activities under the provision of the Coastal Wetlands Protection Act, Title 49, Chapter 27, Mississippi Code of 1972.
The applicant is proposing to construct three piers totaling 17,005 square feet, dredge an area measuring 207 feet by 15 feet, and transplant 10 square feet of marsh vegetation. The applicant also proposes to fill 0.011 acre of coastal wetlands to create a sand beach that will provide a safe water access point for paddle boarders and kayakers. The project is located on Krebs Lake, Pascagoula, Jackson County, Mississippi.
The applicant has requested a Use Plan Change from the General Use (G) District to an Industrial District (I) for the proposed project area. The applicant justifies this request under 22 Miss. Admin. Code Pt. 23 Rule 7.3.A. The applicant states: "I believe this property was mislabeled and has been used since 1947 as an industrial site. Originally logs were shipped by barge from South America, floated and stored in Krebs Lake until used for manufacturing. We are now developing part of the property into a recreational marina."
The applicant has requested a variance to 22 Miss. Admin. Code, Pt. 23 R. 8.15.A. which states "Permanent filling of coastal wetlands below the ordinary high-water mark is not authorized." and justified the request using 22 Miss. Admin. Code, Pt. 23 R. 8.19.C. which states " No feasible, alternative sites or construction techniques are available; there is a significant public benefit in the activity; and a public hearing has been conducted and R. 8.19.D which states "The activity requires a waterfront location; there is a significant public benefit in the activity; and a public hearing has been conducted."
In compliance with Section 401 of the Federal Water Pollution Control Act (33 U.S.C. 1251, 1341), as amended by PL 95-217, the applicant will request certification from the Office of Pollution Control that the above mentioned activity will be in compliance with applicable provisions of Section 301 (33 U.S.C. 1311), Section 302 (33 U.S.C. 1312), Section 303 (U.S.C. 1313), Section 306 (U.S.C. 1316), and Section 307 (U.S.C. 1317) of the Act and appropriate requirements of the State Law.
The MDMR will conduct a public hearing regarding the permit application Tuesday, September 1, 2026, at 5:30 p.m. at the Jackson County General Services Complex, 2915 Canty Street Pascagoula, MS 39567. This hearing will provide the opportunity for the community to submit comments concerning the proposed project. It is not a question-and-answer session. Any person wishing to make comments on the proposed activity may attend and submit comments orally or in writing.
