CITY OF PASCAGOULA, MISSISSIPPI
AN ORDINANCE OF THE CITY OF PASCAGOULA, MISSISSIPPI AMENDING CHAPTER 94, ARTICLE II, OF THE CODE OF ORDINANCES REGARDING THE USE AND OPERATION OF THE PASCAGOULA INNER HARBOR
WHEREAS, Mississippi Code Section 21-37-15 grants municipalities certain authorities to regulate waterways, including the authority to regulate public wharves and docks; and
WHEREAS, Chapter 94, Article II, of the Pascagoula Code of Ordinances regulates the use and operation of the Pascagoula Inner Harbor; and
WHEREAS, certain revisions to Chapter 94, Article II, are needed to provide for the safe and efficient use of the Pascagoula Inner Harbor; and
WHEREAS, the City Council for the City of Pascagoula hereby amends Chapter 94, Article II, as set forth herein.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PASCAGOULA AS FOLLOWS:
SECTION 1. Chapter 94, Article II, Section 94-45 is hereby amended to read as follows:
(a.) Before being assigned berthing facilities or space for any watercraft, the owner or master or duly authorized agents of the owner of any watercraft shall make application in writing for berthing facilities or space. Before the owner or master or any person in charge of any watercraft is permitted to occupy any berth, slip or docking space, there must have first been executed a rent contract therefor, in the harbor berthing lease agreement provided by the city.
(b.) Whenever there are more applicants for berths than there are available berths, the city may maintain a waiting list of applicants. Applicants who are citizens of the City of Pascagoula shall have priority on the waiting list above all other applicants. Whether an applicant is a citizen of the City of Pascagoula shall be determined based on documentation deemed sufficient by the harbor master. The Harbor Master shall have discretion in managing the waiting list to promote efficient use of the berths, including placing vessels in appropriately-sized berths.
SECTION 2. Chapter 94, Article II, Section 94-48, Subsection (a), is hereby amended to read as follows:
(a.) For any berth tenant who is a citizen of the City of Pascagoula, the rental for docking a watercraft at the city dock of the Inner Harbor shall be $4.00$5.00 per lineal foot of watercraft deck length (bow to stern) per month without regard to the time the watercraft is actually docked at such city dock. For any berth tenant who is not a citizen of the City of Pascagoula, the rental for docking a watercraft at the city dock of the Inner Harbor shall be $6.75 $7.00 per lineal foot of watercraft deck length (bow to stern) per month without regard to the time the watercraft is actually docked at such city dock. The minimum rental for all vessels shall be based on twenty-five (25) lineal feet. Any vessel longer than twenty-five (25) lineal feet shall be charged according to its actual length.
SECTION 3. The amendments to this Chapter shall become effective as provided by law.
