TO: Any and all persons having or claiming to have any right, title or interest in and to the following described real property, or who would be adversely affected by the closing and vacating of the lots, streets, alleys and property, being more particularly described as follows, to-wit:
The following described property located in REVISION OF MAGNOLIA GROVE SUBDIVISION, a subdivision according to the official map or plat thereof on file and of record in the office of the Chancery Clerk of the First Judicial District of Harrison County, Mississippi, in Plat Book 3 at page 36 (Copy Book 1A at Page 83) thereof, to-wit:
Lots Seven (7), Eight (8), Nine (9), Ten (10), Eleven (11), and Twelve (12), Block Twenty-four (24), and
Lots One (1), Two (2), Three (3), Four (4), Five (5), Six (6), Seven (7), Eight (8), Nine (9), Ten (10), Eleven (11), and Twelve (12), Block Twenty-eight (28), together with the alley that runs through the middle of said Block, and
Lots One (1), Two (2), Three (3), Four (4), Five (5), and Six (6), Block Thirty-one (31), and
Lots One (1), Two (2), Three (3), Four (4), Five (5), and Six (6), Block Thirty-two (32), and
That certain portion of 29th Street (7th Street on Plat) lying South of the aforesaid Block 24 and North of the aforesaid Block 28, and
That certain portion of 28½th Street (8th Street on Plat) lying South of the aforesaid Block 28 and North of the aforesaid Block 32, and
That certain portion of C Avenue (4th Avenue on Plat) lying East of the aforesaid Block 31 and West of the aforesaid Block 32, and
AND ALSO:
The following described property located in EAST MAGNOLIA GROVE ADDITION, a subdivision according to the official map or plat thereof on file and of record in the office of the Chancery Clerk of the First Judicial District of Harrison County, Mississippi, in Plat Book 3 at page 47 (Copy Book 2 at Page 94) thereof, to-wit:
Lots Ten (10), Eleven (11), Twelve (12), Thirteen (13), Fourteen (14), Fifteen (15), Sixteen (16), Seventeen (17), and Eighteen (18), Block Twenty (20), and
Lots One (1), Two (2), Three (3), Four (4), Five (5), Six (6), Seven (7), Eight (8), Nine (9), Ten (10), Eleven (11), Twelve (12), Thirteen (13), Fourteen (14), Fifteen (15), Sixteen (16), Seventeen (17), Eighteen (18), Block Twenty-one (21), together with the alley that runs through the middle of said Block, and
That certain portion of 29th Street (7th Street on Plat) lying South of the aforesaid Block 20 and North of the aforesaid Block 21, and
AND ALSO:
The following described property located in HEWES ADDITION, a subdivision according to the map or plat thereof on file and of record in the office of the Chancery Clerk of the First Judicial District of Harrison County, Mississippi, in Plat Book 3 at Page 10 (Copy Book 5A at Page 476B) thereof, to-wit:
Lots One through Forty-one Inclusive (1-41 Inclusive), Block Twenty (20), lying East of the existing drainage canal, LESS AND EXCEPT that portion of the above described property conveyed to the City of Gulfport, Mississippi, by Jane Stanley in the Deed recorded as Instrument Number 2006-7550-D-J1, and
That certain portion of the alley that runs through the aforesaid Block 20 that is East of the aforesaid portion of said Block conveyed to the City of Gulfport, Mississippi, by Jane Stanley in the Deed recorded as Instrument Number 2006-7550-D-J1, and
That certain portion of 28th Street (9th Street on Plat) lying North of the aforesaid Block Twenty (20), from a Northerly extension of the West line of Lot Forty-one (41), Block Twenty (20), HEWES ADDITION, to a Southerly extension of the West line of D Avenue (5th Avenue on Plat).
AND ALSO: That certain portion of D Avenue (5th Avenue of Plat) lying East of Blocks 24 and 28 of the said REVISION OF MAGNOLIA GROVE SUBDIVISION and West of Blocks 20 and 21 of the said EAST MAGNOLIA GROVE ADDITION, which is South of a line drawn from the Northeast corner of Lot Seven (7), Block Twenty-four (24), of the said REVISION OF MAGNOLIA GROVE SUBDIVISION, to the Northwest corner of Lot Ten (10), Block Twenty (20), of the said EAST MAGNOLIA GROVE ADDITION, that extends South to the North margin of 28 ½ th Street (8th Street on Plat) .
It is the intention herein to vacate the aforesaid Plats for all of such property, whether they be lots, streets, avenues, alleys or otherwise, that lies within the perimeter of the area highlighted in orange as shown on Exhibit "A" attached to the Complaint herein and highlighted with blue diagonal lines thereon.
You have been made a Defendant in the suit filed in this Court by LACLEY, LLC, Plaintiff, seeking a Complaint to Close and Vacate Lots and Unused Streets and Alley. Defendants other than you in this action are: City of Gulfport, Mississippi.
You are required to mail or hand deliver a written response to the Complaint filed against you in this action to Donald R. Jones, Attorney for Plaintiff, whose post office address is Post Office Box 7555, Gulfport, MS 39506 and whose street address is 1605 23rd Avenue, Gulfport, MS 39501.
YOUR RESPONSE MUST BE MAILED OR DELIVERED NOT LATER THAN FIVE (5) DAYS AFTER THE 24TH DAY OF JUNE, 2026, WHICH IS THE DATE OF THE FIRST PUBLICATION OF THIS SUMMONS. IF YOUR RESPONSE IS NOT SO MAILED OR DELIVERED, A JUDGMENT BY DEFAULT WILL BE ENTERED AGAINST YOU FOR THE MONEY OR OTHER RELIEF DEMANDED IN THE COMPLAINT.
You must also file the original of your Response with the Clerk of this Court within a reasonable time afterward.
