STATE OF MISSISSIPPI COUNTY OF HARRISON SUBSTITUTE TRUSTEE'S NOTICE OF SALE WHEREAS, Smoke Stop 8441, LLC executed and delivered a Promissory Note ("Note") in favor of Richard J. Viator, in the principle amount of THREE HUNDRED EIGHTY THOUSAND AND 00/100 DOLLARS ($380,000.00) on the 25th day of February, 2025; and WHEREAS, in order to secure said Note, Smoke Stop 8441, LLC, executed and delivered a Deed of Trust to Casano Law Firm, P.A., as Trustee for Richard J. Viator, said Deed of Trust being dated February 27, 2025, and recorded on March 5, 2025 as Instrument 2025-0004016-T-J1 (11 pages recorded) in the Office of the Chancery Clerk of Harrison County, First Judicial District, Mississippi; and WHEREAS, said Mortgagor has defaulted in the terms of said Deed of Trust by failing to make the payments therein as specified and failing to pay the interest thereon, and under the terms of said Deed of Trust, said indebtedness is declared due and payable; and WHEREAS, Richard J. Viator has demanded that the same be foreclosed in the manner provided therein so as to satisfy the indebtedness thereby secured; and WHEREAS, said Deed of Trust provides that the Holder thereof may foreclose the Deed of Trust in accordance with applicable state law. NOW THEREFORE, I, Michael J. Casano of Casano Law Firm, P.A., Trustee, as aforesaid, will on the 10th day of June, 2026, offer for sale and sell during the legal hours (between the hours of 11:00 a.m. and 4:00 p.m.) at the front door of the Courthouse of Harrison County, 1st Judicial District, Mississippi, located at Gulfport, Mississippi, at public outcry, to the highest bidder for cash, the following described property, together with the appurtenances and improvements thereunto belonging, or in any wise appertaining, lying and being situated in Harrison County, State of Mississippi, and being more particularly described as follows, to-wit: A parcel of land situated and being in Section 29, Township 7 South, Range 13 West, First Judicial District, Harrison County, Mississippi, more particularly described as follows to-wit: Commence at that point where the North Line of the Northwest Quarter (NW1/4) of the Southwest Quarter (SW 1/4) of Section 29, Township 7 South, Range 13 West, Harrison County, Mississippi, intersects the East margin of Smith Road and thence run south along said East margin 177.6 feet to the point of beginning of that property herein described; from said point of beginning, thence run Southeasterly 240 feet along the South margin of Kiln Delisle Road to an iron rod; thence run south 153.52 feet to an iron rod; thence run West 194.8 feet to an iron rod situated on the East margin of Smith Road; thence Run North along said East margin 293.69 feet back to the point of beginning. Said parcels contains 1.0 acres, more or less. Title to said property is believed to be good, but I convey only such title as is vested in me as Trustee.
