SUBSTITUTE TRUSTEE'S NOTICE OF SALE WHEREAS, on October 1, 2007, Paul Anthony Looney, Sr. and Rebecca June Looney executed a deed of trust for the benefit of American General Financial Services, Inc., which deed of trust was recorded on October 3, 2007, as Instrument No. 2007 19388 T -J1, in the office of the Chancery Clerk of Harrison County, Mississippi; Said Deed of Trust was last sold, assigned and transferred to U.S. BANK TRUST NATIONAL ASSOCIATION, NOT IN ITS INDIVIDUAL CAPACITY BUT SOLELY AS OWNER TRUSTEE FOR RCAF ACQUISITION TRUST by assignment recorded as Instrument No. 2025-0012022-T-J1 in the office of the Chancery Clerk of Harrison County, Mississippi. WHEREAS, the holder of the deed of trust at the time of the substitution substituted McCalla Raymer Leibert Pierce, LLP as Trustee, as authorized by the terms thereof, by instrument recorded April 7, 2026 and spread at large upon the records in the office of the aforesaid Chancery Clerk as Instrument No. 2026-0006468-T-J1 prior to the posting and publication of this notice; and WHEREAS, default having been made in the terms and conditions of the deed of trust, and the entire debt secured thereby having been declared to be due and payable in accordance with the terms of the deed of trust, and the legal holder of said indebtedness, U.S. BANK TRUST NATIONAL ASSOCIATION, NOT IN ITS INDIVIDUAL CAPACITY BUT SOLELY AS OWNER TRUSTEE FOR RCAF ACQUISITION TRUST, has requested the undersigned Substitute Trustee to execute the trust and sell said land, property and improvements in accordance with the terms of the deed of trust for the purpose of raising the sums due thereunder, together with attorney's fees, Substitute Trustee's fees and expenses of sale; THEREFORE, on June 10, 2026, the undersigned Substitute Trustee in the deed of trust, will offer for sale at public outcry and sell to the highest bidder for cash, within legal hours (being between the hours of 11:00 a.m. and 4:00 p.m.) at the East front door of the Harrison County Courthouse in Gulfport, Mississippi, the following described land, property and improvements lying and being situate in Harrison County, Mississippi, to-wit: PARCEL OF LAND SITUATED IN AND BEING A PART OF THE NORTHWEST 1/4 OF THE NORTHEAST 1/4 OF SECTION 17, TOWNSHIP 07 SOUTH, RANGE 12 WEST, FIRST JUDICIAL DISTRICT OF HARRISON COUNTY, MISSISSIPPI, AND BEING MORE PARTICULARLY DESCRIBED AS FOLLOWS: COMMENCING AT AN IRON ROD WITHIN A CAPPED IRON PIPE MARKING THE NORTHEAST CORNER OF SAID SECTION 17, RUN WESTERLY ALONG THE SECTION LINE SOUTH 89 DEGREES 57 MINUTES WEST 1,319.4 FEET TO A CONCRETE MONUMENT MARKING THE NORTHEAST CORNER OF THE NORTHWEST 1/4 OF THE NORTHEAST 1/4 OF SAID SECTION 17 AND THE NORTHEAST CORNER OF A 50 FOOT WIDE EASEMENT FOR INGRESS / EGRESS RUNNING SOUTHERLY, SAID POINT ALSO BEING ON THE SOUTHERN MARGIN OF A 30 FOOT EASEMENT FOR JAKE BELL ROAD, THEN RUN WESTERLY ALONG THE SAID SOUTHERN MARGIN OF JAKE BELL ROAD SOUTH 89 DEGREES 28 MINUTES WEST 50.0 FEET TO AN IRON ROD MARKING THE NORTHWEST CORNER OF SAID 50 FOOT EASEMENT AND ALSO BEING ON THE SOUTHERN MARGIN OF SAID 30 FOOT EASEMENT OF JAKE BELL ROAD, THEN CONTINUE WESTERLY, SOUTH 89 DEGREES 28 MINUTES WEST 438.2 FEET TO A COTTON SPINDLE FOR THE POINT OF BEGINNING. FROM SAID POINT OF BEGINNING, POINT BEING THE NORTHEAST CORNER FOR THIS PARCEL, RUN SOUTHERLY LEAVING SAID SOUTHERN MARGIN OF JAKE BELL ROAD, SOUTH 00 DEGREES 21 MINUTES EAST 270.0 FEET TO AN IRON ROAD MARKING THE SOUTHEAST CORNER FOR THIS PARCEL, THEN RUN SOUTH 89 DEGREES 28 MINUTES WEST 300.0 FEET TO AN IRON ROD MARKING THE SOUTHWEST CORNER FOR THIS PARCEL AND ALSO BEING THE SAME SOUTHWEST CORNER OF THE 3-ACRE PARCEL DESCRIBED IN DEED BOOK 1299 PAGE 292, AND ALSO BEING THE WESTERN MARGIN OF A 30 FOOT EASEMENT FOR INGRESS/ EGRESS, THEN RUN NORTHERLY ALONG WESTERN MARGIN OF SAID 30 FOOT EASEMENT NORTH 00 DEGREES 21 MINUTES WEST 270.0 FEET TO A COTTON SPINDLE MARKING THE NORTHWEST CORNER FOR THIS PARCEL AND OF THE SAID 30 FOOT EASEMENT ALSO BEING ON THE SOUTHERN MARGIN OF SAID JAKE BELL ROAD, THEN RUN EASTERLY ALONG SAID SOUTHERN MARGIN NORTH 89 DEGREES 28 MINUTES EAST 300.0 FEET TO THE POINT OF BEGINNING. Said property will be sold subject to any outstanding ad valorem taxes (including taxes which are a lien, but not yet due and payable), the right of redemption of any taxing authority, all outstanding liens for public utilities which constitute liens upon the property, any matters which might be disclosed by an accurate survey and inspection of the property, any assessments, liens, encumbrances, easements, rights-of-way, zoning ordinances, restrictions, special assessments, covenants, and any matters of record including, but not limited to, those superior to said Deed of Trust first set out above. Said property will be sold on an "as-is" basis without any representation, warranty or recourse against the above-named or the undersigned. The successful bidder must present certified funds in the amount of the winning bid at the time of sale, as well as timely comply with FinCEN data submission and certification requirements, if applicable. ATTENTION ALL PROSPECTIVE BIDDERS: On March 1, 2026, the data collection and reporting requirements under the U.S. Financial Crimes Enforcement Network (FinCEN) new Anti-Money Laundering Rule (Rule), found at 89 FR 70258, went into effect.* The Rule applies to certain residential real estate sale transactions, including nonjudicial foreclosures, where the transfer is to a legal entity or trust, and the source of funds is non-financed (which includes cash, certified funds, private financing, or financing provided by an institution not subject to a federal Anti-Money Laundering or Suspicious Activity Report requirement.) As part of this Rule, purchasers are required to provide additional information and documentation about themselves, their legal entities, and the source of funds used in the reportable transaction, if applicable. The collection of this information and documentation by the Substitute Trustee is required to comply with the Rule's reporting requirements, if applicable. The Substitute Trustee, on behalf of the holder of the Deed of Trust, reserves the right to rescind the foreclosure sale at its own discretion.
