SUBSTITUTE TRUSTEE'S NOTICE OF FORECLOSURE SALE WHEREAS, on April 12, 2019, EDDIE TOLBERT, III, AN UNMARRIED MAN, executed a Deed of Trust to JOHN MORRIS, ATTORNEY, as Trustee and, JPMORGAN CHASE BANK, N.A, as Beneficiary, which Deed of Trust is on file and of record in the office of the Chancery Clerk of Jackson County, Mississippi, in Book 3577, Page 785 as Instrument Number 201908736; which Deed of Trust has been duly transferred and assigned to U.S. BANK TRUST NATIONAL ASSOCIATION, NOT IN ITS INDIVIDUAL CAPACITY BUT SOLELY AS OWNER TRUSTEE OF THE MSRM 2025-RPL1 Trust by assignment recorded on February 11, 2026, in Book 4218, Page 894 as Instrument Number 202602665 in the office of the Chancery Clerk of Jackson County, Mississippi; and. WHEREAS, default has occurred in the payment of the indebtedness secured by said deed(s) of trust, and U.S. Bank Trust National Association, not in its individual capacity but solely as owner trustee for Morgan Stanley Residential Mortgage Loan Trust 2025-RPL1, as beneficiary, has authorized and instructed Padgett Law Group as substitute trustee to foreclose said deed(s) of trust by advertisement and sale at public auction in accordance with the statutes made and provided therefor. THEREFORE, notice is hereby given that pursuant to the power of sale contained in said deed(s) of trust and in accordance with the statutes made and provided therefor, the said deed(s) of trust will be foreclosed and the property covered thereby and hereinafter described will be sold at public auction to the highest bidder for cash at the Main Front Door of the Circuit Court Building of Jackson County located at 3104 Magnolia Street, at Pascagoula, Mississippi, and will sell within legal hours (being between the hours of 11:00 AM and 4:00 PM) on May 14, 2026, to satisfy the indebtedness now due under and secured by said deed(s) of trust. The premises to be sold are described as: THAT CERTAIN TRACT, PIECE OR PARCEL OF LAND SITUATED IN SECTION 29, TOWNSHIP 7 SOUTH, RANGE 5 WEST, JACKSON COUNTY, MISSISSIPPI, BEING MORE PARTICULARLY DESCRIBED AS FOLLOWS, TO-WIT: COMMENCING AT A POINT 30 FEET WEST OF THE SE CORNER OF THE NE QUARTER OF THE SE QUARTER OF SECTION 29, TOWNSHIP 7 SOUTH, RANGE 5 WEST, JACKSON COUNTY, MISSISSIPPI; THENCE NORTH 1319.85 FEET TO THE SOUTH MARGIN OF GREGORY STREET; THENCE WEST 449 FEET TO THE POINT OF BEGINNING; THENCE EAST 100 FEET; THENCE SOUTH 188.55 FEET; THENCE WEST 100 FEET; THENCE NORTH 188.53 FEET TO THE POINT OF BEGINNING. The Financial Crimes Enforcement Network ("FinCEN"), a bureau of the U.S. Department of Treasury, now requires the collection, certification and reporting of certain information relating to non-financed transfers of real property to legal entities and/or trusts, which such information the successful bidder(s) shall be expected to provide to the auctioneer at the time of the subject sale. Interested bidders with questions regarding the necessary information to be provided are hereby directed, generally, to FinCEN's website and, more specifically to the FinCEN Real Estate Report located in the forms bank thereof. The successful bidder must tender full funds at the conclusion of the sale in the form of a certified check made payable or endorsed to Padgett Law Group. No personal checks will be accepted. To this end you must bring sufficient funds to outbid the lender and any other bidders. Insufficient funds will not be accepted. Amounts received in excess of the winning bid will be refunded.
