NOTICE OF SUBSTITUTED TRUSTEE'S SALE
WHEREAS, Ebony J. Givens and Donald R Givens, 11263 Bayou Bernard Rd., Gulfport, MS 39503 executed and delivered a certain Promissory Note dated July 28, 2021, for Three Hundred Thousand and 00/100 Dollars ($300,000.00) payable to Newtek Small Business Finance, LLC; and
WHEREAS, as security for said note, Ebony J. Givens and Donald R Givens, 11263 Bayou Bernard Rd., Gulfport, MS 39503 executed and delivered a Deed of Trust to Roger McGehee, Jr., PLLC, as Trustee, with Newtek Small Business Finance, LLC, 1981 Marcus Avenue, Suite 130, Lake Success, NY 11042 as Beneficiary, said Deed of Trust being dated July 28, 2021, recorded in he Records of Mortgages and Deeds of Trust on Land of Harrison County, Mississippi, First Judicial District, bearing Instrument No. 2021-10044-T-J1; and
WHEREAS, said Deed of Trust authorized the appointment and substitution of another Trustee in the place of the Trustee named therein, and Newtek Small Business Finance, LLC, acting by and through Juan Guillen-Juarez, Its Vice President, Liquidation Officer, as the holder of the note did appoint Russell S. Manning of Biloxi, Mississippi of Biloxi, Mississippi to be Trustee under said Deed of Trust in place and instead of with all powers and duties of the original trustee, said appointment of Substituted Trustee dated February 27, 2026, which appears of record in the Records of Mortgages and Deeds of Trust on Land of Harrison County, Mississippi, First Judicial District, bearing Instrument No. 2026-0005237-T-J1; and
WHEREAS, said Ebony J. Givens and Donald R Givens have defaulted in the terms of said Note and Deed of Trust by failing to make payments therein as specified and failing to pay the interest thereon, and under the terms of said Note and Deed of Trust the entire amount of said indebtedness is declared due and payable; and
WHEREAS, said Newtek Small Business Finance, LLC, has demanded that the same be foreclosed in the manner provided therein so as to satisfy the indebtedness thereby secured; and
WHEREAS, said Deed of Trust provided for the sale of said property at the main front door of the Courthouse of Harrison County, Mississippi, First Judicial District;
NOW THEREFORE, I, Russell S. Manning, Substituted Trustee, as aforesaid, will on April 22, 2026, offer for sale and sell during the legal hours (between the hours of 11:00 a.m. and 4:00 p.m.) at the main front door of the County Courthouse of Harrison County, Mississippi, First Judicial District, 1801 23rd Ave., Gulfport, Mississippi 39501, at public outcry, to the highest bidder for cash, the following described property, together with the appurtenances and improvements thereunto belonging, or in any wise appertaining, lying and being situated in Gulfport, Harrison County, Mississippi, First Judicial District, and being more particularly described as follows, to-wit:

Commence at a found Railroad Spike marking the Northwest corner of the Northwest 1/4 of the Southwest 1/4 of Section 12, Township 7 South, Range 12 West, Harrison County, Mississippi; thence South 00 degrees 03 minutes 43 seconds East along the West boundary of said Section 12, a distance of 25.00 feet to a set P. K. Nail for the Point of Beginning; thence South 89 degrees 54 minutes 12 seconds East along a old fence, a distance of 1325.84 feet to a set 1/2 inch re-bar on the East boundary of the Northwest 1/4 of the Southwest 1/4 of said Section 12; thence South 00 degrees 05 minutes 35 seconds East along the East boundary of the Northwest 1/4 of the Southwest 1/4 of said Section 12, a distance of 330.68 feet to a set 1/2 inch re-bar; thence North 89 degrees 54 minutes 12 seconds West, a distance of 1326.02 feet to a set P. K. nail on the West boundary of said Section 12; thence North 00 degrees 03 minutes 43 seconds West along the West boundary of said Section 12, a distance of 330.68 feet to the Point of Beginning. The property is a part of the Northwest 1/4 of the Southwest 1/4 of said Section 12. The Property is subject to a public road right-of-way along the West boundary as shown on the survey plat.

The property is a part of the Northwest ¼ of the Southwest ¼ of said Section 12. The property is subject to a public road right-of-way along the West boundary as shown on the survey plat.

Title to the above described property conveyed to Donald R. Givens and Ebony J. Givens, husband and wife, as joint tenants with full rights of survivorship from Wallace C. Fore by Warranty Deed dated February 9, 2018 and recorded February 16, 2018 in or Instrument No. 2018-938 D J-1.
The above being the identical property described in the foregoing Deed of Trust as described therein.
The title to the above property is believed to be good; however, I will convey only such title as is vested in me under the terms and conditions of the aforementioned Deed of Trust.
