SUBSTITUTE TRUSTEE'S NOTICE OF FORECLOSURE SALE WHEREAS, on August 28, 2020, JOHN DAVID UZZELL, JR. AND BROOKE A. UZZELL, HUSBAND AND WIFE, executed a Deed of Trust to SECURITY TITLE, as Trustee and, MORTGAGE ELECTRONIC REGISTRATION SYSTEMS, INC., AS NOMINEE FOR PARAMOUNT RESIDENTIAL MORTGAGE GROUP, INC., ITS SUCCESSORS AND ASSIGNS, as Beneficiary, which Deed of Trust is on file and of record in the office of the Chancery Clerk of Jackson County, Mississippi, in Book 3702, Page 791, as Instrument Number 202019297; which Deed of Trust has been duly transferred and assigned to NEWREZ LLC D/B/A SHELLPOINT MORTGAGE SERVICING, by assignment recorded on January 3, 2023, in Book 3962, Page 788 , as Instrument Number 202300030, in the office of the Chancery Clerk of Jackson County, Mississippi, and having been modified in Loan Modification Agreement recorded on February 21, 2024, in Book 4050, at Page 706, as Instrument Number 202402941 in the office of the Chancery Clerk of Jackson County, Mississippi; and. WHEREAS, default has occurred in the payment of the indebtedness secured by said deed(s) of trust, as modified, and NEWREZ LLC D/B/A SHELLPOINT MORTGAGE SERVICING, as beneficiary, has authorized and instructed Padgett Law Group as substitute trustee to foreclose said deed(s) of trust, as modified, by advertisement and sale at public auction in accordance with the statutes made and provided therefor. The Financial Crimes Enforcement Network ("FinCEN"), a bureau of the U.S. Department of Treasury, now requires the collection, certification and reporting of certain information relating to non-financed transfers of real property to legal entities and/or trusts, which such information the successful bidder(s) shall be expected to provide to the auctioneer at the time of the subject sale. Interested bidders with questions regarding the necessary information to be provided are hereby directed, generally, to FinCEN's website and, more specifically to the FinCEN Real Estate Report located in the forms bank thereof. The successful bidder must tender full funds at the conclusion of the sale in the form of a certified check made payable or endorsed to Padgett Law Group. No personal checks will be accepted. To this end you must bring sufficient funds to outbid the lender and any other bidders. Insufficient funds will not be accepted. Amounts received in excess of the winning bid will be refunded.
