SUMMONS BY PUBLICATION IN THE CHANCERY COURT OF HARRISON COUNTY, MISSISSIPPI SECOND JUDICIAL DISTRICT CEDAR LAKE MEDICAL PLAZA, LLC PLAINTIFF VERSUS CAUSE NO. 24CH2:26-cv-00144-MA ROBERT M. DALEY and JEREMIA R. DALEY; HARRISON COUNTY, MISSISSIPPI; AND ANY AND ALL PERSONS CLAIMING ANY INTEREST IN AND TO THE FOLLOWING DESCRIBED PROPERTY: DEFENDANTS A certain tract of land located in the Northeast Quarter of the Southeast Quarter of Section 12, Township 7 South, Range 10 West, City of Biloxi, Harrison County, Mississippi, containing 28.20 acres, more or less, being more particularly described as follows: Commence at a 3/8" iron rod at the Southwest corner of the Northeast Quarter of the Southeast Quarter of Section 12, Township 7 South, Range 10 West, City of Biloxi, Harrison County, Mississippi also being the POINT OF BEGINNING; thence proceed North 00 degrees 01' 15" East a distance of 1,320.99 feet to a point marked by a 3/8" iron rod; thence proceed South 89 degrees 49' 23" East a distance of 250.46 feet to the Southerly right-of-way line of U.S. Interstate Highway 10 interchange and corner marked by a 3/8" iron rod; thence continue along said right-of-way line of Interstate 10 Interchange South 62 degrees 42' 31" East a distance of 3.32 feet to a corner marked by a 6" x 6" M.D.O.T. right-of-way monument; thence continue along same right-of-way line South 54 degrees 30' 06" East a distance of 307.48 feet to a corner marked by a 6" x 6" M.D.O.T. right-of-way monument; thence continuing along right-of-way South 48 degrees 10' 23" East a distance of 871.50 feet to a corner marked by a 6" x 6" M.D.O.T. right-of-way monument; thence continue along right-of-way line South 25 degrees 14' 50" East a distance of 240.17 feet to a corner marked by a fence post; thence proceed South 85 degrees 46' 43" West a distance of 200.17 feet to a corner marked by a 5/8" iron rod; thence proceed South 3 degrees 45' 41" East a distance of 175.00 feet to a corner marked by a ½" iron rod; thence proceed North 86 degrees 14' 31" East a distance of 250.00 feet to a corner marked by ½" iron pipe being on the Westerly right-of-way of Cedar Lake Road; thence proceed along said Cedar Lake Road right-of-way line South 3 degrees 43' 06" East a distance of 186.38 feet to a corner marked by a found nail; thence proceed North 89 degrees 15' 32" West a distance of 1,328.53 feet to the Point of Beginning, as shown on survey dated August 13, 1997, by GWS Engineering, Inc. attached hereto as Exhibit "A" and made a part hereof. Said parcel being part of that property conveyed to the Grantor herein by Warranty Deed dated July 7, 1997, as recorded in Deed Book 313, Pages 435-442, and by that Corrected Deed dated October, 1997, both on file in Land Deed Records of the Second Judicial District, Harrison County, Mississippi. (SUMMONS BY PUBLICATION) THE STATE OF MISSISSIPPI TO: ANY AND ALL PERSONS CLAIMING ANY INTEREST IN AND TO THE ABOVE DESCRIBED PROPERTY THE COMPLAINT WHICH IS ATTACHED TO THIS SUMMONS IS IMPORTANT AND YOU MUST TAKE IMMEDIATE ACTION TO PRESERVE YOUR RIGHTS. You have been made a Defendant in the suit filed in this Court by Cedar Lake Medical Plaza, LLC, seeking to remove cloud on title, to quiet and confirm title, or in the alternative, to confirm title by adverse possession. Defendants other than you in this action are: Robert M. Daley, Jeremia R. Daley, and Harrison County, Mississippi. You are required to mail or hand deliver a written response to the Complaint filed against you in this action to David A. Wheeler, Attorney for Plaintiff, whose post office address is P.O. Box 264, Biloxi, MS 39533. YOUR RESPONSE MUST BE MAILED OR DELIVERED NOT LATER THAN THIRTY DAYS AFTER THE 11th DAY OF MARCH, 2026, WHICH IS THE DATE OF THE FIRST PUBLICATION OF THIS SUMMONS. IF YOUR RESPONSE IS NOT SO MAILED OR DELIVERED, A JUDGMENT BY DEFAULT WILL BE ENTERED AGAINST YOU FOR THE MONEY OR OTHER RELIEF DEMANDED IN THE COMPLAINT.
