SUBSTITUTE TRUSTEE'S NOTICE OF SALE WHEREAS, on May 3, 2004, Everette Lafaun Waits and Beverly J Waits, husband and wife executed a deed of trust for the benefit of Mortgage Electronic Registration Systems, Inc., as beneficiary, as nominee for Transland Financial Services, Inc., its successors and assigns, which deed of trust was recorded on May 10, 2004, as Instrument No. 2004 8376 T-J1, in the office of the Chancery Clerk of the First Judicial District of Harrison County, Mississippi; Said Deed of Trust was last sold, assigned and transferred to NewRez LLC d/b/a Shellpoint Mortgage Servicing by assignment recorded as Instrument No. 2020 1749 T-J1 in the office of the Chancery Clerk of Harrison County, Mississippi. WHEREAS, the holder of the deed of trust at the time of the substitution substituted McCalla Raymer Leibert Pierce, LLP as Trustee, as authorized by the terms thereof, by instrument recorded March 29, 2024 and spread at large upon the records in the office of the aforesaid Chancery Clerk as Instrument No. 2024-0005781-T-J1 prior to the posting and publication of this notice; and WHEREAS, default having been made in the terms and conditions of the deed of trust, and the entire debt secured thereby having been declared to be due and payable in accordance with the terms of the deed of trust, and the legal holder of said indebtedness, NewRez LLC, has requested the undersigned Substitute Trustee to execute the trust and sell said land, property and improvements in accordance with the terms of the deed of trust for the purpose of raising the sums due thereunder, together with attorney's fees, Substitute Trustee's fees and expenses of sale; THEREFORE, on March 25, 2026, the undersigned Substitute Trustee in the deed of trust, will offer for sale at public outcry and sell to the highest bidder for cash, within legal hours (being between the hours of 11:00 a.m. and 4:00 p.m.) at the East front door of the Harrison County Courthouse (1st Judicial District) in Gulfport, Mississippi, the following described land, property and improvements lying and being situate in Harrison County, Mississippi, to-wit: Lots 1 to 24, inclusive, in Block 2, and Lots 1 to 3 and 16 to 24, all inclusive in Block 3 of Mohler and Avera's Subdivision in Harrison County, Mississippi, as per map or plat thereof recorded in Book 3, Page 69 of the Records of Plats on file in the office of the Chancery Clerk of Harrison County, Mississippi. AND ALSO: That parcel of land formerly designated as First Street, being 280 feet in length by 30 feet in width and lying directly North of, and adjacent to, Lot 24, in Block 2 of Mohler and Avera's Subdivision and south of that portion of Lot 12 of Seal's Subdivision lying directly north of Lot 24, in Blook 2 of Mohler and Avera's Subdivision in Harrison County, Mississippi, which said portion of First Street was vacated by Order of the Chancery Court of Harrison County, Mississippi in Cause NO. 45,919 on the docket of said Court, which said parcel of land being more particularly described as follows: Beginning at the northwest corner of Lot 24, Block 2, Mohler & Avera's Subdivision and run thence north a distance of 30 feet; thence run east a distance of 30 feet, run thence east a distance of 280 feet, run thence south a distance of 30 feet to the northeast corner of said Lot 24, run thence west a distance of 260 feet to the point of beginning. AND ALSO: That certain parcel of land being in and a part of Lot 12 of Seal's Subdivision of the east half of Sections 2, 11 and 14, Township 8 South, Range 12 West, in Harrison County, Mississippi, better described as: Commencing at the northwest corner of Lot 24, Block 2 of Mohler & Avera's Subdivision, and run thence north a distance of 30 feet to the place of beginning; run thence north a distance of 20 feet to a stake, run thence east a distance of 280 feet to a stake; run South a distance of 20 feet to a stake; run thence west a distance of 280 feet to the point of beginning: being the west 280 feet of the south 20 feet of Lot 12 of Seal's Subdivision. AND ALSO, An alley 20 feet by 600 feet running in a north-south direction and lying in the center of Block 2, Mohler and Avera's Subdivision in as said plat pertains to that portion of West Avenue lying directly west and adjacent to the property owned by the parties as described herein in Mohler and Avera's Subdivision, Harrison County, Mississippi. Said property being vacated by the Harrison County Board of Supervisors in Cause No. 65,947 of the Chancery Court of the First Judicial District of Harrison County, Mississippi. AND ALSO: A right of way for road purposes on and over the following described property, to-wit: That certain parcel of land located in Lot 12 of Seal's Subdivision of the east half of Sections 2, 11 and 14, Township 8 South, Range 12 West in Harrison County, Mississippi and described as beginning on the northwest corner of Lot 24 in Block 2 of Mohler and Avera's Subdivision, and run thence north a distance of 690 feet, more or less, along a line which would be the east margin of West Avenue if same were extended to the south margin of Commission Road; run thence west along the west margin of Commission Road a distance of 30 feet: run thence South a distance of 690 feet, more or less, to a point directly west of the point of beginning run thence east a distance of 30 feet to the place of beginning. It being the purpose of this right-of-way to serve for road purposes for the property above described and all the property herein nonveyed. Said right-of-way to be perpetual and used just as though it had been formally dedicated to the public use as a road. Said property will be sold subject to any outstanding ad valorem taxes (including taxes which are a lien, but not yet due and payable), the right of redemption of any taxing authority, all outstanding liens for public utilities which constitute liens upon the property, any matters which might be disclosed by an accurate survey and inspection of the property, any assessments, liens, encumbrances, easements, rights-of-way, zoning ordinances, restrictions, special assessments, covenants, and any matters of record including, but not limited to, those superior to said Deed of Trust first set out above. Said property will be sold on an "as-is" basis without any representation, warranty or recourse against the above-named or the undersigned. The successful bidder must present certified funds in the amount of the winning bid at the time and place of sale. ATTENTION ALL PROSPECTIVE BIDDERS: On March 1, 2026, the data collection and reporting requirements under the U.S. Financial Crimes Enforcement Network (FinCEN) new Anti-Money Laundering Rule (Rule), found at 89 FR 70258, will go into effect. The Rule applies to certain residential real estate sale transactions (including some that go beyond the typical one-to-four family residence) where the transfer is to a legal entity or trust, and which includes cash purchases, private financing or financing provided by an institution not subject to a federal Anti-Money Laundering or Suspicious Activity Report requirement. As part of this Rule, buyers and sellers are required to provide additional information and documentation about themselves, their legal entities, and/or the source of funds used in the reportable transaction. The collection of this information and documentation is required to comply with the Rule's federal reporting requirements. This notice is provided for informational purposes only and does not constitute legal advice. You are encouraged to consult with your own independent legal counsel if you have questions about how the FinCEN Anti-Money Laundering Rule affects your transaction and whether your transaction is reportable. The sale will be conducted subject (1) to confirmation that the sale is not prohibited under the U.S. Bankruptcy Code, (2) to final confirmation and audit of the status of the loan with the holder of the Deed of Trust, and (3) to confirmation that the successful bidder has timely provided all information required by the Rule, 89 FR 70258. The Substitute Trustee, on behalf of the holder of the Deed of Trust, reserves the right to rescind the foreclosure sale at its own discretion.
