ORDINANCE NO. 02-2026
CITY OF PASCAGOULA, MISSISSIPPI
AN ORDINANCE OF THE CITY OF PASCAGOULA, MISSISSIPPI AMENDING CHAPTER 74 OF THE CODE OF ORDINANCES REGARDING
THE OCCUPANCY OF THE CITY'S RIGHTS-OF-WAY;
TO PROVIDE FOR AN EFFECTIVE DATE; AND FOR RELATED PURPOSES.
WHEREAS, Chapter 74 of the City of Pascagoula's Code of Ordinances contains regulations regulating the City's streets, sidewalks, and other public places; and
WHEREAS, certain revisions to Chapter 74 are needed to promote public safety and protect the City's infrastructure; and
WHEREAS, Mississippi Code Section 21-37-3 grants municipalities full jurisdiction in the matters of streets and sidewalks; and
WHEREAS, Mississippi Code Section 21-27-5 grants municipalities jurisdiction to prescribe terms and conditions on the use of streets, alleys, and other public grounds for the purpose of laying, constructing, repairing and maintaining gas, water, sewer, or steam pipes, or conduits for electric light, telegraph and telephone lines, and pipe lines for the purpose of transporting crude oil, crude petroleum, kerosene, gasoline, and other commodities transportable by pipe line; and
WHEREAS, Mississippi Code Section 21-19-31 grants municipalities jurisdiction to regulate public grounds; and
WHEREAS, Mississippi Code Section 21-19-25 grants municipalities jurisdiction to adopt ordinances dealing with the public health, safety, or welfare; and
WHEREAS, additional regulations regarding the occupancy of the City's rights-of-way by utility companies and their contractors will promote public safety, ensure the City receives
sufficient information regarding work conducted in rights-of-way, and protect the City's infrastructure; and
WHEREAS, the City Council for the City of Pascagoula hereby amends Chapter 74 of the Code of Ordinances as set forth herein.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PASCAGOULA AS FOLLOWS:
SECTION 1. Chapter 74, Article III of the Code of Ordinances is hereby amended to add Section 74-91, which shall read as follows:
Sec. 74-91 – Work hours.
Except for emergency repairs, work conducted or pursued in accordance with a permit shall be between the hours of 7:00 a.m. and 6:00 p.m., prevailing time. Starting or warming up equipment prior to 7:00 a.m. is prohibited. Starting or warming up equipment after 12:00 p.m. on Fridays is also prohibited. Work on the weekend or legal holidays is prohibited, unless specifically authorized by the city engineer or his or her designee.
SECTION 2. The amendments to this Chapter shall become effective as provided by law.
