NOTICE OF SUBSTITUTED TRUSTEE'S SALE
WHEREAS, on 01/11/2007, TWAYA DELISA HUTCHINS executed a Promissory Note payable to the order of NOVASTAR MORTGAGE, INC., AS LENDER.
WHEREAS, the aforesaid Promissory Note was secured by a Deed of Trust dated 01/11/2007, executed by TWAYA DELISA HUTCHINS, A SINGLE PERSON and being recorded on 01/23/2007 in Book 2531, Page 518 as Document No. 200703255 of the records of the Jackson County, State of Mississippi; and which aforesaid Instrument conveys to Robert S. Coleman Jr. P.A., Trustee and to NOVASTAR MORTGAGE, INC AS LENDER, MORTGAGE ELECTRONIC REGISTRATION SYSTEMS, INC., as Beneficiary, the hereinafter described property; and
WHEREAS, NOVASTAR MORTGAGE, INC AS LENDER, MORTGAGE ELECTRONIC REGISTRATION SYSTEMS, INC., AS BENEFICIARY assigned said Deed of Trust to Deutsche Bank National Trust Company, as Trustee for NovaStar Mortgage Funding Trust, Series 2007-1 NovaStar Home Equity Loan Asset-Backed Certificates, Series 2007-1 via an instrument filed of record on April 12, 2024 as Document No. 202406345, in Book 4061, and at Page 479 in the office of the Clerk of the Jackson County, State of Mississippi; and
WHEREAS, DEUTSCHE BANK NATIONAL TRUST COMPANY, AS TRUSTEE FOR NOVASTAR MORTGAGE FUNDING TRUST, SERIES 2007-1 NOVASTAR HOME EQUITY LOAN ASSET-BACKED CERTIFICATES, SERIES 2007-1 appointed WESTERN PROGRESSIVE - MISSISSIPPI, INC, as Substitute Trustee in the place of the aforementioned original Trustee via an instrument dated 01/07/2026 and recorded on 01/12/2026 in Book 4212, Page 512-514 as Document No. 202600487 of the records of the Jackson County, State of Mississippi and
WHEREAS, default having occurred under the terms and conditions of said Promissory Note and Deed of Trust and the holder having declared the entire balance due and payable; and
WHEREAS, Western Progressive - Mississippi, Inc., the Substituted Trustee in said Deed of Trust will on 02/18/2026, between the hours of 11:00 a.m. and 4:00 p.m., offer for sale and will sell at public outcry to the highest bidder for cash at the Jackson County Courthouse, 3104 Magnolia Street, Pascagoula, MS 39567, the following described property located and situated in Jackson County, Mississippi, to wit:
LYING AND BEING SITUATED IN JACKSON COUNTY, MISSISSIPPI BEING MORE PARTICULARLY DESCRIBED AS FOLLOWS, TO-WIT:
THE EAST 73 FEET OF THE WEST 148 FEET OF LOT 23 OF THE THOMPSON-HOWZE TRACT, IN THE CITY OF MOSS POINT, IN CLAIM SECTION 15, TOWNSHIP 7 SOUTH, RANGE 6 WEST, JACKSON COUNTY, MISSISSIPPI, AS PER PLAT THEREOF RECORDED IN BOOK 9, PAGE 420, LAND DEED RECORDS OF JACKSON COUNTY, MISSISSIPPI.
BEING THE EAST 73 FEET OF THE WEST 148 FEET OF THAT CERTAIN PARCEL OF LAND CONVEYED FROM GERALDINE MCINTOSH TO ERNESTIN M. HUTCHINS ON THE 8TH DAY OF NOVEMBER, 1990, AND RECORDED IN BOOK 1034, PAGES 869-870, LAND DEED RECORDS OF JACKSON COUNTY, MISSISSIPPI, AND BEING THE EAST 73 FEET OF THE WEST 148 FEET OF THAT CERTAIN PARCEL OF LAND CONVEYED TO GERALDINE MCINTOSH BY P. W. MCINTOSH ON THE 26TH DAY OF FEBRUARY, 1962, AND RECORDED IN BOOK 487, PAGE 542.
BEING THE SAME PREMISES AS CONVEYED IN DEED FROM TWAYA DELISA HUTCHINS AND DARRIEN CLARENCE MIMS RECORDED 11/23/05 IN DOCUMENT NUMBER 200528184, BOOK 1397, PAGE 35-37 IN SAID COUNTY AND STATE.
More commonly known as: 3716 BARNETT ST, MOSS POINT, MS 39563-3809
Subject to the rights of way and easement for public roads and public utilities, and to any prior conveyance or reservation of mineral of every kind and character, including but not limited to oil, gas, sand, and gravel in or under subject property.
As the undersigned Substituted Trustee, Western Progressive - Mississippi, Inc, will convey only such title as is vested in it under said Deed of Trust.
