ORDINANCE NO. 11-2025 CITY OF PASCAGOULA, MISSISSIPPI AN ORDINANCE TO AMEND ORDINANCE NO. 1-2011 (UNIFIED DEVELOPMENT ORDINANCE) TO CHANGE THE ZONING OF CERTAIN PARCELS OF LAND LYING GENERALLY IN THE AREA NORTH OF INGALLS AVE AND WEST OF RESCA DE LA PALMA ST FROM SINGLE FAMILY RESIDENTIAL (SFR6) TO NEIGHBORHOOD COMMERCIAL (NC) WHEREAS, Brenda Kay Ramm, on behalf of the owner of the subject property, proposes to have the zoning of the parcels described below changed from Single Family Residential 6 (SFR6) to Neighborhood Commercial (NC); and WHEREAS, a public hearing on the proposal was held by the Pascagoula Planning Board on the 10th day of December 2025, after due notice thereof, at which time the Planning Board unanimously voted to recommend approval of the rezoning; and WHEREAS, a second public hearing on the proposal was held by the City Council on the 16th day of December 2025, at which time all interested persons were given an opportunity to be heard; and WHEREAS, the Planning and Building Director, Josh Church, recommended granting the rezoning request; and WHEREAS, we find that the zoning change is supported by the evidence adduced at the hearing, is reasonable, and is in the public interest; and WHEREAS, we further find that the current zoning of the property listed below is not consistent with the surrounding uses of the neighborhood listed and deters development, particularly considering that the subject property is adjacent to property zoned Neighborhood Commercial (NC); and WHEREAS, we further find that the change in zoning will encourage the development of the Ingalls Ave corridor; and WHEREAS, we further find that the change in zoning satisfies the review standards listed in the Unified Development Ordinance, insofar as the change in zoning is required by changed conditions and addresses a demonstrated community need. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PASCAGOULA, MISSISSIPPI: SECTION 1: Ordinance 1-2011 (Unified Development Ordinance) is hereby amended to change the zoning of the following described land in Pascagoula, Jackson County, Mississippi from Single Family Residential (SFR6) to Neighborhood Commercial (NC) District: That certain parcel of land described as part of lot 25 of the original survey of the Sarrazin Tract, lying and being in section 5, Township 8 South, Range 6 West and being more particularly described as follows: Beginning at the Northwest corner of Ingalls Avenue and an unopened street designated as Resca De La Palma, run North 8 degrees 30' West a distance of 171' to the Southeast corner of lot 25 of the original survey of the Sarrazin Tract for a point of beginning run North 8 degrees 30' West a distance of 186.3 feet, thence South 69 degrees 66'West 153.1 feet, more or less to the West line of lot 25 of the original survey of the Sarrazin Tract; Thence South 8 degrees 30' East along the west line of lot 25 to the Southwest corner of lot 25 at the point of beginning. Said property bearing parcel identification number 41940057.000. SECTION 2. The uses within the properties included within this ordinance shall operate in a manner that does not cause excessive noise, odor, dust, vibrations, or similar nuisance activities. SECTION 3. The zoning map adopted by and incorporated in Ordinance 1-2011 (Unified Development Ordinance) shall be revised to show this change. SECTION 4. This ordinance shall become effective as provided by law. SECTION 5. This ordinance shall not be codified. The motion to approve the foregoing ordinance was made by Councilwoman Brandenstein and seconded by Councilman Blythe, and the following vote was recorded: Mayor Willis Aye Councilwoman Brandenstein Aye Councilman Stallworth Aye Councilman Fornett Aye Councilwoman Young Aye Councilman Parker Recused Councilman Blythe Aye SO ORDAINED, this the 16th day of December, 2025.
