NOTICE OF SUBSTITUTE TRUSTEE'S SALE
WHEREAS, on October 10, 2024, Donald C. Hughes, executed a Deed of Trust to Jay K. Jordan, Trustee for the benefit of Scott Delk, which Deed of Trust is recorded in the Records of Mortgages and Deeds of Trust on Land by Instrument No. 2024-0006343-T-J2 in the office of the Chancery Clerk of the Second Judicial District of Harrison County, Mississippi; and,
WHEREAS, Scott Delk appointed and substituted Michael B. McDermott in the place and stead of said original trustee named in the aforesaid original Deed of Trust, by instrument filed of record in the office of the Chancery Clerk and recorded in said office by Instrument No. 2025-0007706-T-J2; and
WHEREAS default having been made in the terms and conditions of said Deed of Trust in favor of Scott Delk, and the holder of the note and Deed of Trust having requested the Substitute Trustee to sell the subject property, I will, on the 7th day of January, 2026, offer for sale and sell at public outcry, between the hours of 11:00 A.M. and 4:00 P.M. at the main south door of the county courthouse of the Second Judicial District of Harrison County, Mississippi, for cash to the highest bidder, the following described property, lying and being situated in the Second Judicial District of Harrison County, State of Mississippi, to-wit:
Unit Number 84, Phase 19, in the plan of condominium known as ANATOLE BAY TOWNHOMES, as same is recorded in Plat Book 9 at Page 17 and re-plat thereof, recorded in Plat Book 10 at Page 22, and as same is otherwise created, established and dedicated in a certain Condominium Declaration Creating and Establishing Anatole Bay Homeowners' Association, filed for record in Deed Book 129 at Page 174; and that certain Incremental Development Amendment recorded in Book 166 at Page 439 and Book 266 at Page 213 and as Amended by order recorded as Instrument Number 2017-3115-D-J2 in the records of the Chancery Clerk of Harrison County, Second Judicial District of Mississippi; together with and undivided 1/90th interest in and to the common areas of Anatole Bay which are appurtenant to the unit as such is defined in the aforesaid Condominium Declaration.
Together with non-exclusive perpetual use of Boat Slip No. 17. It is understood and agreed that the use of said boat slip cannot be transferred by the Grantee herein, separate and apart from the above described condominium unit. The Grantee herein is restricted in that the use of said boat slip must be transferred with the condominium unit above described.
I will convey only such title as is vested in me as Substitute Trustee.
