SUBSTITUTED TRUSTEE'S NOTICE OF SALE
WHEREAS, on March 22, 2013, Jacqueline D. Dodds, an unmarried woman and Annias Fortenberry, an unmarried man executed a certain deed of trust to D. Jeffrey Wagner, Trustee for the benefit of Mortgage Electronic Registration Systems, Inc. as beneficiary, as nominee for Hope Federal Credit Union, its successors and assigns which deed of trust is of record in the office of the Chancery Clerk of Jackson County, State of Mississippi in Book 3117 at Page 402 Instrument No. 201305278 and re-recorded in Book 3125 at Page 369 Instrument No. 201307293; and
WHEREAS, LLG MS LLC has heretofore been substituted as Trustee by instrument dated January 29, 2024 and recorded in the aforesaid Chancery Clerk's Office in Instr. #202402326 Book 4048 Page 651; and
WHEREAS, default having been made in the terms and conditions of said deed of trust and the entire debt secured thereby having been declared to be due and payable in accordance with the terms of said deed of trust, Hope Federal Credit Union, the legal holder of said indebtedness, having requested the undersigned Substituted Trustee to execute the trust and sell said land and property in accordance with the terms of said deed of trust and for the purpose of raising the sums due thereunder, together with attorney's fees, trustee's fees and expense of sale.
NOW, THEREFORE, I, LLG MS LLC, Substituted Trustee in said deed of trust, will on January 9, 2026 offer for sale at public outcry and sell within legal hours (being between the hours of 11:00 a.m. and 4:00 p.m.), at the Main West Front Door of the County Courthouse of Jackson County, located at 3104 Magnolia Street, Pascagoula, MS 39567, to the highest and best bidder for cash or certified funds the following described property situated in Jackson County, State of Mississippi, to-wit:
Lot 21 of the J.A. Donovan Estates Subdivision as per plat thereof recorded in Surveyors Record Book 1, Page 137 of the Chancery Clerk of Jackson County, Mississippi, and the same being a subdivision of Lots 18 and 25, inclusive, Square D, of the Kerr Tract, as per plat of said Kerr Tract of Record in Book 7, Page 99 of the Jackson County Land Deed Records.
LESS AND EXCEPT:
A part of the South 7 feet of Lot 21, plus a part of the South 7 feet of the West 8 feet of Lot 20, J.A. Donovan Estate Subdivision, as recorded in Surveyors Record Book 1, Page 137, in the Office of the Chancery Clerk of Jackson County, Mississippi, and more particularly described as follows, to-wit:
Commence at the Southwest corner of Lot 21, known as the point of beginning; thence run Northerly, along the West line of Lot 21, for a distance of 2 feet to a point; thence in a Northeasterly direction over and across the line that separates Lot 21 from Lot 20, for a distance of 58.17 feet to an existing fence line; thence Southerly along said existing fence line for a distance of 7 feet to a point on the South line of Lot 20; thence in a Westerly direction along the South lot lines of Lots 20 & 21, for a distance of 57.85 feet to the point of beginning.
LESS AND EXCEPT:
A parcel of land being a part of Lot 21, J.A. Donovan Estates Subdivision as per plat thereof recorded in Surveyor's Record Book 1, Page 137 of the Chancery Clerk of Jackson County, Mississippi, and being a subdivision of Lots 1 & and 25, inclusive, Square D, of the Kerr Tract, as per plat of said tract in Deed Book 7,
Page 99 of the Records of the Chancery Clerk of Jackson County, Mississippi,
better described as follows to-wit:
Commencing at the Southwest corner of Lot 21, J.A. Donovan Estates subdivision, thence N 08°30'00" E 9.52 feet to the south property line of 1503 School Avenue and the Point of Beginning; thence N 08°30'00" E 158.48 feet to the Northeast corner of said Lot 21, thence S 81°30'00" E 3.21 feet along thenorth line of said Lot 21 to a fence line, thence S 09°18'11" W 158.46 feet along said fence line to a fence post, thence N 83°47'01" W 0.99 feet to the Point of Beginning.
I WILL CONVEY only such title as vested in me as Substituted Trustee.
