SUBSTITUTE TRUSTEE'S NOTICE OF SALE
WHEREAS, on November 1, 2024, Charles McCaleb Sr. and Stephanie McCaleb, as Joint Tenants with the Rights of Survivorship and not as tenants in common, executed a deed of trust for the benefit of Mortgage Electronic Registration Systems, Inc., as beneficiary, as nominee for United Trust Bank, its successors and assigns, which deed of trust was recorded on November 15, 2024, as Instrument No. 202421558, in Book 4111, Page 168, in the office of the Chancery Clerk of Jackson County, Mississippi; Said Deed of Trust was last sold, assigned and transferred to NewRez LLC d/b/a Shellpoint Mortgage Servicing by assignment recorded in Book 4138, Page 178 as Instrument No. 202505102 in the office of the Chancery Clerk of Jackson County, Mississippi.
WHEREAS, the holder of the deed of trust at the time of the substitution substituted McCalla Raymer Leibert Pierce, LLP as Trustee, as authorized by the terms thereof, by instrument recorded November 19, 2025 and spread at large upon the records in the office of the aforesaid Chancery Clerk in Book 4199, Page 591 prior to the posting and publication of this notice; and
WHEREAS, default having been made in the terms and conditions of the deed of trust, and the entire debt secured thereby having been declared to be due and payable in accordance with the terms of the deed of trust, and the legal holder of said indebtedness, NewRez LLC d/b/a Shellpoint Mortgage Servicing, has requested the undersigned Substitute Trustee to execute the trust and sell said land, property and improvements in accordance with the terms of the deed of trust for the purpose of raising the sums due thereunder, together with attorney's fees, Substitute Trustee's fees and expenses of sale;
THEREFORE, on January 7, 2026, the undersigned Substitute Trustee in the deed of trust, will offer for sale at public outcry and sell to the highest bidder for cash, within legal hours (being between the hours of 11:00 a.m. and 4:00 p.m.) at the front door of the Jackson County Courthouse at 3104 Magnolia Street, Pascagoula, Mississippi, the following described land, property and improvements lying and being situate in Jackson County, Mississippi, to-wit:
Part of Lot 54 of the Denny-McInnis Tract in the City of Moss Point, situated in Claim Sections 10 and 15, Township 7 South, Range 6 West, Jackson County, Mississippi, as per plat thereof recorded in Deed Book 16, Page 32-1/2, Land Deed Records of Jackson County, Mississippi, and more particularly described as follows, to-wit:
Commencing at an iron pin marking the NE corner of the property conveyed to Ada Street by Deed recorded in Deed Book 1041, Pages 213-215, Land Deed Records of Jackson County, Mississippi, said point being South 270 feet from the NE corner of Lot 41 Denny-McInnis Tract (per plat in Deed Book 16, Page 32-1/2), said point being the point of commencement; thence run South a distance of 210.35 feet to the point of beginning, said point of beginning being South 1,577.63 feet and West 521.85 feet from the interior corner of said Claim Section 10, which corner is also the most Northern NW corner of Claim Section 15, Township 7 South, Range 6 West, Jackson County, Mississippi, thence run South along the East margin of Weems Street a distance of 119.65 feet to the North line of the Kate Barnett Tract, thence run South 81 degrees 31 minutes 44 seconds West along the North line of said Kate Barnett Tract a distance of 190.07 feet to the East margin of Thompson Street, thence run North along the East margin of Thompson Street a distance of 118.00 feet, thence run North 81 degrees 02 minutes 21 seconds East a distance of 190.35 feet to the point of beginning. A plat and survey of the hereinabove described property prepared by L.J. Achee, Jr. and dated August 26, 2003, is recorded in Deed Book 1316, Page 92, Land Deed Records of Jackson County, Mississippi. And being the same land conveyed to Thomas S. Street by Deed dated September 10, 2006, and recorded in Book 1316, Pages 90-92, Land Deed Records of Jackson County, Mississippi. And being part of the land conveyed to Ada Street by Deed recorded in Book 1041, Pages 213-215, and shown on plat of Hubert Grant dated July 9, 1980, and recorded in Deed Book 1041, Page 215, Land Deed Records of Jackson County, Mississippi.
Being the same property conveyed to Charles McCaleb and Stephanie McCaleb, as Joint Tenants with the Rights of Survivorship and not as tenants in common by First Federal Savings and Loan Association of Pascagoula-Moss Point in deed dated 12/15/2021 recorded 12/17/2021 in Book/Page 2053/194 or Instrument 202131655 in the County of Jackson and State of Mississippi.
