CITY OF PASCAGOULA, MISSISSIPPI
AN ORDINANCE TO AMEND ORDINANCE NO. 1-2011 (UNIFIED DEVELOPMENT ORDINANCE) TO CHANGE THE ZONING OF CERTAIN PARCELS OF LAND LYING GENERALLY IN THE AREA SOUTH OF ANDREW AVE AND WEST OF TELEPHONE RD FROM NEIGHBORHOOD COMMERCIAL (NC) DISTRICT TO COMMUNITY COMMERCIAL (CC) DISTRICT
WHEREAS, the City of Pascagoula proposes to have the zoning of the parcels described below changed from Neighborhood Commercial (NC) to Community Commercial (CC); and
WHEREAS, a public hearing on the proposal was held by the Pascagoula Planning Board on the 12th day of November 2025, after due notice thereof, at which time the Planning Board voted to recommend approval of the rezoning; and
WHEREAS, a second public hearing on the proposal was held by the City Council on the 18th day of November 2025, at which time all interested persons were given an opportunity to be heard; and
WHEREAS, the City Council finds that the zoning change is supported by the evidence adduced at the hearing, is reasonable, and is in the public interest; and
WHEREAS, the City Council finds that the change in zoning will encourage the development of the Telephone Road corridor; and
WHEREAS, the City Council further finds that the proposed change is zoning is required by changed conditions and addresses a demonstrated community need, insofar as the current uses of these properties have become inconsistent with their original zoning and changing the zoning of these properties to a Community Commercial (CC) District will expand the uses of these properties so as to encourage growth and reduce blight caused by vacancies.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PASCAGOULA, MISSISSIPPI:
SECTION 1. The City Council for Pascagoula, Mississippi hereby adopts the forgoing recitals as its findings.
SECTION 2. Ordinance 1-2011 (Unified Development Ordinance) is hereby amended to change the zoning of the following described land from Neighborhood Commercial (NC) to Community Commercial (CC) District:
Parcel #41470010.100 – 4707 Telephone Rd.
That certain tract, piece or parcel of land located and situated in Claim Section 1, Township 8 South, Range 6 West, Jackson County, Mississippi, being more particularly described as follows, to-wit:
Commencing at the Northeast corner of said Claim Section 1; thence South 159.62 feet (reorded-109.00 feet); thence South 84 degrees 54 minutes West 1253.0 feet; thence south 2 degrees 24 minutes West 111.0 feet; thence South 4 degrees 25 minutes West 304.3 feet; thence South 9 degrees 20 minutes 206.3 feet; thence south 89 degrees 46 minutes West 9.32 feet to the West right-of-way of State Highway 613, said point being on the North line of that property described in Deed Book 769, Pages 373-374; thence South 9 degrees 21 minutes 29 seconds West 27.24 feet; thence South 80 degrees 39 minutes 02 seconds East 5.00 feet' thence South 10 degrees 26 minutes 59 seconds west 51.08 feet to a point on the West right-to-way of State Highway 613 and to the Pont of beginning; thence Southwesterly along a curve to the right an arc distance of 98.79 feet, said curve having a delta angle of 4 degrees 54 minutes 25 seconds, a radius of 1153.57 feet and a chord of South 14 degrees 25 minutes 40 seconds West 98.81 feet to the South line of that property; described in Deed Book 769, Pages 373-374; thence North 87 degrees 30 minutes 31 seconds West along said line 226.16 feet; thence North 20 degrees 30 minutes East 80.47 feet; thence North 87 degrees 18 minutes 03 seconds East 222.63 feet to the Point of beginning. As shown on survey of Lewis Adlred, Jr. PLS dated Aril 25, 2004, Said land being part of that property conveyed by Quitclaim Deed to Timothy A. Krebs dated April 5, 2013, and recorded in Book 1722, Pages 112-114, of the Land Deed Records of Jackson County, Mississippi.

SECTION 3. The uses within the properties included within this ordinance shall operate in a manner that do not cause excessive noise, odor, dust, vibrations, or similar nuisance activities; further, such uses shall comply in all other respects with the City's Unified Development Ordinance.
SECTION 4. The zoning map adopted by and incorporated in Ordinance 1-2011 (Unified Development Ordinance) shall be revised to show this change.
SECTION 5. This ordinance shall become effective as provided by law.
SECTION 6. This ordinance shall not be codified.
