SUBSTITUTE TRUSTEE'S NOTICE OF FORECLOSURE SALE WHEREAS on May 16, 2024, Sherri M. Bethea, single woman, executed a Deed of Trust to JOY LAMBERT PHILLIPS, as Trustee, and Mortgage Electronic Registration System, solely as nominee for Hancock Whitney Bank, its successors and assigns, as Beneficiary, which Deed of Trust is on file and of record in the office of the Chancery Clerk of Jackson County, Mississippi, in Book 4070, Page 797 and as Instrument Number 202408756; and WHEREAS, Mortgage Electronic Registration Systems, Inc. as nominee for Hancock Whitney Bank, its successors and assigns, assigned said Deed of Trust to NewRez LLC d/b/a Shellpoint Mortgage Servicing via an instrument dated February 18, 2025 and recorded in Book 4129 at Page 656 – and as Instrument No. 202502520 in the office of the Chancery Clerk of Jackson County, Mississippi, reference to which is hereby made; and, WHEREAS, NewRez LLC d/b/a Shellpoint Mortgage Servicing appointed Padgett Law Group as Substitute Trustee in place of the afore-mentioned original Trustee via an instrument dated November 3, 2025 and recorded in Book 4196 at Page 44 – and as Instrument No. 202521855 - in the office of the Chancery Clerk of Jackson County, Mississippi, reference to which is hereby made; and, WHEREAS, default has occurred in the payment of the indebtedness secured by said deed(s) of trust, and NewRez LLC d/b/a Shellpoint Mortgage Servicing, as beneficiary, has authorized and instructed Padgett Law Group as substitute trustee to foreclose said deed(s) of trust by advertisement and sale at public auction in accordance with the statutes made and provided therefore. THEREFORE, notice is hereby given that pursuant to the power of sale contained in said deed(s) of trust and in accordance with the statutes made and provided therefor, the said deed(s) of trust will be foreclosed and the property covered thereby and hereinafter described will be sold at public auction to the highest bidder for cash at the West front door of the Jackson County Courthouse, 3104 Magnolia Street in Pascagoula, Mississippi, and will sell within legal hours (being between the hours of 11:00 AM and 4:00 PM) on December 22, 2025, to satisfy the indebtedness now due under and secured by said deed(s) of trust. Padgett Law Group will convey only such title as vested in it as Substituted Trustee. The premises to be sold are described as: LOT 5, SANDALWOOD BY THE SEA, PART C, ACCORDING TO THE MAP OR PLAT THEREOF ON FILE AND OF RECORD IN THE OFFICE OF THE CHANCERY CLERK OF JACKSON COUNTY, MISSISSIPPI, IN PLAT BOOK 8, AT PAGE 31 The successful bidder must tender full funds at the conclusion of the sale in the form of a certified check made payable or endorsed to Padgett Law Group. No personal checks will be accepted. To this end you must bring sufficient funds to outbid the lender and any other bidders. Insufficient funds will not be accepted. Amounts received in excess of the winning bid will be refunded. Padgett Law Group reserves the right to award the bid to the next highest bidders should the highest bidder fail to timely tender the total amount due.
