CAUSE NO. 25-1215 DNH thence Westerly along the South boundary of Belfair Subdivision 1,291 feet, more or less, to the point of beginning, CITY OF MOSS POINT, MISSISSIPPI DEFENDANT all in Jackson County, Mississippi. SECTION 4. The City of Pascagoula, Mississippi shall make the following improvements in said NOTICE OF HEARING ON COMPLAINT IN annexed territory to be completed within a reasonable time, not to exceed five (5) years from the effective date of the THE NATURE OF A PETITION FOR THE RATIFICATION, APPROVAL, AND CONFIRMATION OF AN Ordinance, unless delayed by war or military preparedness: ORDINANCE ENLARGING, EXTENDING, AND DEFINING THE CORPORATE LIMITS AND BOUNDARIES (a) Improve existing streets and drainage where necessary and economically feasible and legally OF THE CITY OF PASCAGOULA, JACKSON COUNTY, MISSISSIPPI permissible; (b) Install water lines, water service, sewage disposal lines, sewage treatment facilities, and street lighting, NOTICE IS HEREBY GIVEN that a Complaint in the Nature of a Petition for the Ratification, Approval, where necessary and economically feasible and legally permissible; and and Confirmation of an Ordinance Enlarging, Extending, and Defining the Corporate Limits and Boundaries of the City of Pascagoula, Jackson County, Mississippi, has been filed in Cause No. 25-1215 DNH pursuant to an (c) Said services shall be furnished in the same manner as such services are being furnished to the Ordinance having been duly and legally adopted by the Mayor and City Council of Pascagoula, Mississippi, on June present citizens, businesses, and property owners of the municipality where necessary and 3, 2025, which Ordinance is in the following words and figures, to wit: economically feasible and legally permissible. ORDINANCE NO. 05-2025 SECTION 5. The City of Pascagoula, Mississippi shall furnish to the said annexed territory the following municipal and public services in the same manner and to the same extent as such services are being furnished to AN ORDINANCE ENLARGING, EXTENDING, AND DEFINING THE CORPORATE LIMITS AND BOUNDARIES the present citizens of the municipality, such services to begin on the effective date of this Ordinance, to wit: OF THE CITY OF PASCAGOULA, JACKSON COUNTY, MISSISSIPPI; SPECIFYING THE IMPROVEMENTS TO BE MADE IN THE ANNEXED TERRITORY AND THE MUNICIPAL OR PUBLIC SERVICES TO BE RENDERED (a) police protection; THEREIN; AND FOR OTHER PURPOSES RELATED THERETO. (b) municipal court services; BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PASCAGOULA, MISSISSIPPI: (c) animal control services; SECTION 1. It is hereby found and determined that the public convenience and necessity require that the corporate boundaries of the City of Pascagoula, Mississippi, be and the same are hereby extended and enlarged (d) first response fire protection and fire prevention services; so as to embrace the adjacent and unincorporated land and territory in Jackson County, Mississippi, hereinafter described. (e) emergency preparedness and civil defense services; SECTION 2. The unincorporated land and territory which is added to and included in the corporate limits (f) maintenance of existing streets, rights of way and drainage structures and facilities; of the City of Pascagoula, Mississippi, is situated in Jackson County, Mississippi, and is more particularly described as follows: (g) street lighting; CITY OF PASCAGOULA, MISSISSIPPI (h) administration of sanitation service; PROPOSED ANNEXATION AREA (i) access to the City’s cultural facilities, services, and programs; Commencing at a point on the existing corporate limits of the City of Pascagoula, Mississippi, as recorded In the Matter of The Enlargement and Extension of the Municipal Boundaries of the City of Pascagoula, Jackson County, (j) access to the City’s parks and recreation facilities and programs; Mississippi, Civil Action No. 99-1175-WM, on July 9, 1999, where the center thread of the West Pascagoula River intersects the South margin of the CSX Railroad right-of-way; thence following said existing corporate limits, run (k) water and sewer utility services at in-city rates for those who are customers of the City utility services; due South 21,500 feet; thence due East approximately 18,500 feet to a point lying on a line which is a southerly extension of the centerline of Market Street, and being the POINT OF BEGINNING; (l) municipal planning and zoning services; thence leaving said existing corporate limits of the City of Pascagoula, run easterly to the intersection of the East line (m) municipal code enforcement and building inspection services; of the West half of Section 27, Township 8 South, Range 5 West, with the South Section Line of said Section 27; (n) the right to fully participate in the affairs of the municipality through direct involvement and the right thence northerly along said East line of the West Half of Section 27 and along the East lines of the West Half of to exercise the ballot (vote) in municipal elections upon registering and meeting all statutory and Sections 22, 15, 10 and 3 of said Township 8 South, Range 5 West to the Township Line separating said Township 8 constitutional requirements; and South and Township 7 South; (o) the use and benefit of all other municipal services and facilities furnished to all present citizens of the thence easterly along said Township Line to its intersection with the East line of the West half of Section 36, City of Pascagoula, Mississippi. Township 7 South, Range 5 West; SECTION 6. The City of Pascagoula, Mississippi shall undertake the following redistricting, planning, thence northerly along said East line of the West half of said Section 36 and along the East lines of the West Half and zoning activities following the effective date of the Ordinance, to wit: of Sections 25, 24 and 15, Township 7 South, Range 5 West to the South margin of the CSX Railroad (formerly the Louisville and Nashville Railroad); (a) Within six (6) months of the effective date of this Ordinance, the City of Pascagoula will prepare and the City Council will adopt a Redistricting Plan for the City Council so as to include all territory and persons thence northeasterly along the South margin of the CSX Railroad (formerly the Louisville and Nashville Railroad) to annexed into the City. The Redistricting Plan shall conform with the Voting Rights Act of 1965, as its intersection with the Mississippi/Alabama State Line; amended. This Redistricting Plan will provide for proportional representation of all persons annexed and will in all other ways conform with applicable Federal regulations; thence northerly along said Mississippi/Alabama State Line to its intersection with the center thread of Franklin Creek; (b) The City of Pascagoula shall enlarge, update, revise, and amend its Comprehensive Plan to include all territory annexed into the municipality and the City Council shall adopt such revisions fulfilling all thence following the meanderings of the center thread of Franklin Creek, run generally westerly through Sections 32 legal requirements to do so including public notice and a public hearing on enlargement, updating, and 31, Township 6 South, Range 4 West and Section 36, Township 6 South, Range 5 West to its intersection with revision, and amendment of the Comprehensive Plan; and the center thread of the Escatawpa River; (c) Following modification of the Comprehensive Plan to include territories annexed, the City of Pascagoula thence following the meanderings of the center thread of the Escatawpa River, run generally southerly and westerly shall prepare and adopt an Official Zoning Map and such Zoning Ordinance text amendments, as are through said Section 36 and Sections 1, 2, 11, 14, and 15, Township 7 South, Range 5 West to its intersection with warranted to implement an adopted Comprehensive Plan. All territory annexed shall be included on the the East Section Line of Section 16, Township 7 South, Range 5 West, said point being on the existing corporate City’s Official Zoning Map and shall be classified thereon in conformance with the City’s adopted limits of the City of Moss Point as described In the Matter of the Extension of the Boundaries of the City of Moss Comprehensive Plan. Adoption of Zoning Ordinance text amendments to the City’s official Zoning Map Point, Mississippi, Cause No. 49,583, April 27, 1989; by the City Council shall occur after proper notice and public hearing(s). thence following said corporate limits of the City of Moss Point, run southerly along the East Section Line of said SECTION 7. This Ordinance shall become effective ten (10) days after the date of the entry of decree Section 16 to its Southeast corner; of the Chancery Court of Jackson County, Mississippi, approving, ratifying, and confirming the enlargement and extension of the municipal boundaries of the City of Pascagoula, Mississippi as established by this Ordinance and thence southerly along the East Section Line of Section 21, Township 7 South, Range 5 West to its Southeast the final judgment of the said Chancery Court or, in the event an appeal is taken therefrom, within ten (10) days from corner; the final determination of such appeal. All other prior ordinances or enactments in conflict with this Ordinance are hereby repealed. thence southerly along the East Section Line of Section 28, Township 7 South, Range 5 West to its intersection with the Northwest right-of-way of U.S. Route No. 90; SECTION 8. The City of Pascagoula, Mississippi, through its City Attorney Michael R. Moore and Special Counsel J. Chadwick Mask, shall file a petition in the Chancery Court of Jackson County, Mississippi, which thence southwesterly along the Northwest right-of-way of U.S. Route No. 90 to its intersection with said existing petition shall pray for the approval, ratification, and confirmation by said Court of the enlargement and extension corporate limits of the City of Pascagoula; of the municipal boundaries and limits of the City of Pascagoula, Mississippi as herein fixed and determined. The petition shall have attached thereto a certified copy of this Ordinance and a plat showing the boundaries of the thence leaving said existing corporate limits of the City of Moss Point run easterly, northeasterly, and southerly and said City of Pascagoula, Mississippi, as they will exist in the event such enlargement and extension becomes continue along said existing corporate limits of the City of Pascagoula as recorded In the Matter of The Enlargement effective pursuant to this Ordinance; and that the attorneys for the City of Pascagoula, Mississippi and the governing and Extension of the Municipal Boundaries of the City of Pascagoula, Jackson County, Mississippi, Civil Action No. authorities are hereby authorized to file such other pleadings in the Chancery Court of Jackson County, Mississippi, 99-1175-WM, on July 9, 1999, to the POINT OF BEGINNING. and take all other necessary steps such that the expansion of the municipal boundaries authorized hereby be ratified, approved, and confirmed according to the laws of the State of Mississippi. SECTION 3.
