WHATCOM COUNTY NOTICE OF APPLICATION FOR A LAND FILL AND GRADE PERMIT AND INTENT TO ISSUE A
SEPA DETERMINATION
OF NON-SIGNIFICANCE
Notice is hereby given that on 5/26/2026, Robb Dibble applied for a Land Fill and Grade Permit under case number LFG2026-00046 for the second phase of the site's industrial development. Scope of work includes clearing, grading, and creating building pads for up to four future industrial use (warehouse and wholesale) buildings, ranging in size from 4,000 to 25,000 square feet. The proposed project will have direct and indirect wetland impacts that are proposed to be mitigated through the purchase of bank use credits from the Lummi Nation Wetland and Habitat Mitigation Bank. Impacts include the complete fill of four Category IV wetlands totaling 18,840 square feet (0.433 acre) in size and 9,860 square feet (0.226 acre) of indirect impacts to a Category III wetland. The application was determined complete on 6/12/2026. The project site is located at 139 Smokey Drive, Bellingham, within Section 06, Township 38 North, Range 03 East of W.M.; Assessor's Parcel No: 3803060632140000. The project will be reviewed under the Official Whatcom County Zoning Ordinance and Title 24, Title 22, Title 21, Title 20, Title 17, Title 16, International Building Code (IBC), Title 12, Whatcom County Development Standards, Washington State Stormwater Manual and State Environmental Policy Act (SEPA) as applicable. Mitigation may be required pursuant to these ordinances. Whatcom County Planning and Development Services has reviewed the proposal for probable adverse impacts and expects to issue a Determination of Non-Significance (DNS) for the project pursuant to the Optional DNS process per WAC 197-11-355. This may be your only opportunity to comment on the environmental impacts of the proposed project. A copy of the subsequent threshold determination for the specific proposal may be obtained upon request. Any person may submit written comments to at PDS@co.whatcom.wa.us within 14-days of the publication of this notice. Written comments must be received by July 15, 2026. Any person has the right to receive notice of and participate in any hearings, request a copy of the decision once made, and to appeal a decision when allowed by law. In addition, any person wishing to receive personal notice of any decisions or hearings must notify the department to receive such notice.
