WHATCOM COUNTY REVISED NOTICE OF APPLICATION FOR A BINDING SITE PLAN AND LAND FILL AND GRADE AND INTENT TO ISSUE A SEPA DETERMINATION OF NON-SIGNIFICANCE Notice is hereby given that on 4/16/2026, Delta Pacific LLC Revised their application for a Binding Site Plan, SEPA checklist, and Land Fill & Grade Permit under case number BSP2023-00001, SEPA2023-00037, and LFG2026-00044 to alter the use of Tract C, the community Septic Drainfield Tract within Delta Tech Industrial Park, to light industrial / commercial activity. Lot 25 (Tract C) is proposed to be served by public water from the Infra Pacific Group-A Water System and proposes to connect to the existing relocated community (OSS) located on Lot 8. The applicant proposes to connect to the existing storm-water infrastructure previously developed under the Binding Site Plans. The project will be reviewed under the State Environmental Policy Act for the alteration of uses, stormwater, and associated infrastructure requirements. The Revised application is for fill and storm water impacts across three lots, proposed Lot 25 and existing Lots 14 and 15. Revised documents include revised site plan, SEPA checklist, Land Fill & Grade permit, and Stormwater Plan. The application was determined complete on May 26, 2023 and June 02, 2026. The project site is located at Ø, 2549, 2557. & 2633 Delta Ring Rd, within Section 01, Township 39 North, Range 01 East of W.M.; Assessor's Parcel No: 3901015132530000, 3901014872510000, 3901014672510000, & 3901014153900000. The project will be reviewed under the Official Whatcom County Zoning Ordinance and Title 24, Title 22, Title 21, Title 20, Title 17, Title 16, International Building Code (IBC), Title 12, Whatcom County Development Standards, Washington State Stormwater Manual and State Environmental Policy Act (SEPA) as applicable. Mitigation may be required pursuant to these ordinances. Whatcom County Planning and Development Services has reviewed the proposal for probable adverse impacts and expects to issue a Determination of Non-Significance (DNS) for the project pursuant to the Optional DNS process per WAC 197-11-355. This may be your only opportunity to comment on the environmental impacts of the proposed project. A copy of the subsequent threshold determination for the specific proposal may be obtained upon request. The file and supporting documents may be viewed at the Whatcom County Planning and Development Services office at 5280 Northwest Drive, Bellingham, WA or at http://www.whatcomcounty.us/2914/Public-Notice. Any person may submit written comments to at PDS@co.whatcom.wa.us within 14-days of the publication of this notice. Written comments must be received by July 13, 2026. Any person has the right to receive notice of and participate in any hearings, request a copy of the decision once made, and to appeal a decision when allowed by law.
