ACTION PROPOSED (INTRODUCED) The Whatcom County Council will consider adopting and may amend the following at its 9:30 a.m. Special Council meeting on March 31, 2026, or at a later date: ORDINANCE AMENDING WHATCOM COUNTY CODE CHAPTER 2.56, DEFENSE AND INDEMNIFICATION OF EMPLOYEES, TO INCLUDE RESERVATION OF RIGHTS AND REIMBURSEMENT (AB2026-233): This ordinance adds a reimbursement and reservation of rights provision to Whatcom County Code Chapter 2.56 to allow the county to deny indemnification or seek reimbursement if a final judicial determination establishes that an officer, agent, official, or employee acted outside the scope of employment, or acted with malice, fraud, corruption, or bad faith. Ordinance introduced March 17, 2026.
