Notice of Lawsuit UNITED STATES DISTRICT COURT WESTERN DISTRICT OF WASHINGTON AT SEATTLE Notice by Publication Civil Action No. 2:25-cv-02294 UNITED STATES OF AMERICA, Plaintiff, v. 34 ACRES OF LAND, More or Less, located in Whatcom County, Washington, Defendant. To Anyone claiming an interest in defendant REAL property: A verified civil complaint was filed in the United States District Court for the Western District of Washington by Plaintiff United States of America, on behalf of the United States Environmental Protection Agency ("EPA"), against Defendant real property, consisting of 34 acres of land located at 4242 Aldergrove Road, Ferndale, 98248, Whatcom County, Washington ("Property"). The complaint was filed pursuant to Section 107(a) of the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 (also known as "CERCLA"), 42 U.S.C. § 9607(a). The Property is also known as the Treoil Industries Site and is subject to a federal lien perfected on August 29, 2023. The complaint alleges that the United States is entitled to an order that the Property be sold and the proceeds from such sale be paid to the United States in reimbursement of response costs covered by the federal lien and incurred by EPA in responding to releases or threatened releases of hazardous substances at the Property. All persons claiming an interest in or right against the Property may contest the United States' complaint for access by filing a statement of interest in the Property no later than fourteen (14) days after publication of this Notice and by filing an answer to the complaint not later than twenty-one (21) days after filing a statement of interest. A copy of the complaint can be obtained by calling the U.S. Department of Justice, Environmental Enforcement Section at 303-514-4192 or by emailing a request to Katherine.Matthews@usdoj.gov. The statement of interest and the answer to the complaint must be filed with the United States District Court for the Western District of Washington and served upon Katherine L. Matthews, Senior Counsel, Environmental Enforcement Section, Environment and Natural Resources Division, U.S. Department of Justice, P.O. Box 7611, Washington, D.C. 20044-7611. If you fail to timely file a statement of interest and answer, the United States will apply to the above-entitled Court for the relief requested in its verified complaint and the Court may issue an order granting the relief requested by Plaintiff without further notice.
