IN THE CIRCUIT COURT TWENTIETH JUDICIAL CIRCUIT St. CLAIR COUNTY, ILLINOIS IN THE MATTER OF THE ESTATE OF THOMAS MCKIBBEN, Deceased. Case No. 26-PR-120 CLAIM NOTICE NOTICE IS HEREBY GIVEN of the death of Thomas McKibben, on the 22nd day of February 2026. On March 12, 2026, Gary Emmons was appointed the Executor of the Estate and the Will was admitted to probate. The Executor's attorney is the, Law Office of Van-Lear P. Eckert, P.C., 103 West Main Street, Belleville, Illinois 62220. The Estate will be administered without Court supervision unless, under 755 ILCS 5/28-4, any interested person terminates independent administration at any time by mailing or delivering a petition to terminate to the Clerk. Claims against the Estate may be filed in the Office of the Clerk of the Court at the St. Clair County Courthouse, 10 Public Square, Belleville, Illinois, or with the Executor, or both, within six (6) months from the date of the order appointing the Executor of the Estate, and any claim not filed within such time is barred. Copies of claims filed with the Clerk must be mailed or delivered to the Executor and to the attorney within ten (10) days after filing. This notice is being published for three (3) successive weeks in a newspaper published in the county where the estate is being administered. This notice is being published pursuant to 755 ILCS 5/18-3 and 755 ILCS 5/6-10. Within forty-two (42) days after the effective date of the original Order of Admission of the will to probate, any heir or legatee may file a petition with the Court to require proof of the Will by testimony of the witnesses to the Will in open Court or other evidence, as provided in Section 6-21 of the Probate Act. An heir or legatee also has the right under Section 8-1 of the Probate Act to contest the validity of the Will by filing a petition with the Court within six (6) months after admission of the Will to Probate. Under Section 28-4 of the Probate Act any interested person may terminate Independent Administration at any time by mailing or delivering a petition to terminate to the Clerk of the Court. However, if there is a Will, which directs Independent Administration, Independent Administration will be terminated only if the Court finds there is good cause to require supervised administration; and if the petitioner is a creditor or non-residuary legatee, Independent Administration will be terminated only if the Court finds that termination is necessary to protect the Petitioner's interest.
