WHATCOM COUNTY NOTICE OF APPLICATION FOR A LAND FILL AND GRADE AND INTENT TO ISSUE A SEPA MITIGATED DETERMINATION OF NON-SIGNIFICANCE Notice is hereby given that on October 14, 2025, David Bick applied for a Land Fill and Grade permit under case number LFG2024-00110 for conversion of forest lands to non-forest lands of 1.35 acre. Clearing to include 3 upland areas for residential use. The north area abutting the county road clearing pad proposes 11600 square feet. The central section cleared will be 20588 sf cleared pad. The southern section will include 11472 sf cleared pad. To reach the central section a path will be cleared through unencumbered upland, buffer, and cross approximately 23 – 30 linear feet of wetland. The second wetland crossing will be 14-17 linear feet of wetland. The equipment crossings will be covered with fabric and mulch for temporary impact and then removed upon completion for temporary impact at this phase. The future these crossings are proposed bridged. Clearing will be selective in the three areas as needed for structure and solar panel and applicant expects to retain selected trees and shrub areas within the development pads. The application was determined complete on November 7, 2025. The project site is located at 2053 Benson Road, within Section 02, Township 40 North, Range 3 West of W.M.; Assessor's Parcel No: 4053023852310000. The project will be reviewed under the Official Whatcom County Zoning Ordinance and Title 24, Title 22, Title 21, Title 20, Title 17, Title 16, International Building Code (IBC), Title 12, Whatcom County Development Standards, Washington State Stormwater Manual and State Environmental Policy Act (SEPA) as applicable. Mitigation may be required pursuant to these ordinances. Whatcom County Planning and Development Services has reviewed the proposal for probable adverse impacts and expects to issue a Mitigated Determination of Non-Significance (DNS) for the project pursuant to the Optional MDNS process per WAC 197-11-355. This may be your only opportunity to comment on the environmental impacts of the proposed project. A copy of the subsequent threshold determination for the specific proposal may be obtained upon request. The file and supporting documents may be viewed at the Whatcom County Planning and Development Services office at 5280 Northwest Drive, Bellingham, WA or at http://www.whatcomcounty.us/2914/Public-Notice. Any person may submit written comments to Travis Wilmot at the above address or at TWilmot@whatcomcounty.us within 14-days of the publication of this notice. Written comments must be received by December 1, 2025. Any person has the right to receive notice of and participate in any hearings, request a copy of the decision once made, and to appeal a decision when allowed by law.
