CITY OF CROWLEY NOTICE OF PUBLIC HEARING The City of Crowley City Council will hold a public hearing for the following on Thursday, December 18, 2025 at 7:00 P.M. in the City Council Chambers, located at 201 E Main St, Crowley, Tarrant County, Texas 76036. Hold a public hearing to consider amending the City's Schedule of Rates, Fees, and Charges (Appendix A, Section 1, Subsection 18.5 of the City's Code of Ordinances) to implement a phased increase of the City's Stormwater (Drainage) Utility Fee such that the proposed fee will be $5.00 per Equivalent Residential Unit (ERU) on January 1, 2026 and increase by $0.50 per ERU each fiscal year to a maximum fee of $7.00 per ERU in 2030. ORDINANCE NO 12-2025-581 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CROWLEY, TEXAS AMENDING APPENDIX A, SCHEDULE OF RATES, FEES AND CHARGES OF THE CODE OF ORDINANCES BY AMENDING SUBSECTION 18.5 (STORMWATER (DRAINAGE) UTILITY FEES) TO REVISE THE MONTHLY RATE FOR THE STORMWATER (DRAINAGE) UTILITY FEE; PROVIDING THIS ORDINANCE SHALL BE CUMULATIVE; PROVIDING A SEVERABILITY CLAUSE; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the City of Crowley, Texas is a home rule City acting under its charter adopted by the electorate pursuant to Article XI, Section 5 of the Texas Constitution and Chapter 9 of the Local Government Code; and WHEREAS, the fee schedule of the City of Crowley has been codified as Appendix A of the Crowley Code of Ordinances; and WHEREAS, on October 6, 2011, the City Council of the City of Crowley adopted Ordinance No. 10-2011-171 to establish a Stormwater (Drainage) Utility System; and WHEREAS, on October 6, 2011, the City Council of the City of Crowley also adopted an amendment to the Schedule of Rates, Fees and Charges (Appendix A) by adding Subsection 18.5 entitled Stormwater (Drainage) Utility Fees establishing the rates for the Stormwater (Drainage) Utility fee with an effective date of July 1, 2012 and a scheduled increase from $1.75 per Equivalent Residential Unit (ERU) per month to a fee of $4.00 per ERU per month in FY2021; and WHEREAS, the Municipal Drainage Utility Systems Act (the "Act), Texas Local Government Cod 552.042 et seq., as amended, authorizes the City to prescribe a basis upon which to fund the municipal Drainage Utility System, to assess the fees and charges to support the Municipal Drainage Utility System, and to adjust the rates and charges from time to time; and WHEREAS, the City of Crowley has analyzed its rates and stormwater utility system needs and has determined that a fee adjustment is warranted; and WHEREAS, pursuant to Section 552.045 of the Texas Local Government Code, the City Council provided public notice in the Fort Worth Star-Telegram three times before the date of the public hearing, with the first publication occurring on November 17, 2025, said date being on or before the 30th day before the date of the hearing in accordance with the requirements of the Act; and WHEREAS, the City Council held a public hearing regarding the proposed revised rates for the municipal stormwater (drainage) utility system on December 18, 2025, NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CROWLEY, TEXAS: SECTION 1. Appendix A, Section 1 (Schedule of Rates, Fees, and Charges), Subsection 18.5.c (Stormwater (Drainage) Utility Fees, Schedule of Monthly Fees and Rates) of the Code of the City of Crowley, Texas is hereby amended in its entirety to read as follows: "c. Schedule of monthly fees and rates. The monthly stormwater (drainage) utility fee shall be as follows: 1. The monthly stormwater (drainage) utility fee for each residential dwelling unit or ERU and for each nonresidential parcel (based on the impervious area measured in square fee) shall be as follows beginning January 1, 2026 and subsequently on October 1 of each fiscal year: Fiscal Year Residential ERU Fee Nonresidential Fee per SF FY 2026 $5.00 $0.0020 FY 2027 $5.50 $0.0022 FY 2028 $6.00 $0.0024 FY 2029 $6.50 $0.0026 FY 2030 $7.00 $0.0028 SECTION 2. This ordinance shall be cumulative of all provisions of ordinances of the City of Crowley, Texas except where the provisions of this ordinance are in direct conflict with the provisions of such ordinances, in which event the conflicting provisions of such ordinances are hereby repealed. SECTION 3. It is hereby declared to be the intention of the City Council that all the phrases, clauses, sentences, paragraphs, and sections of this ordinance are severable, and if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared unconstitutional by the valid judgement or decree of any court of competent jurisdiction,, such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this ordinance, since the same would have been enacted by City Council without the incorporation in this ordinance of any such unconstitutional phrase, clause, sentence, paragraph or section. SECTION 4. This ordinance shall be in full force and effect from and after its adoption, and it is so ordained.
