NOTICE OF SALE STATE OF SOUTH CAROLINA IN THE COURT OF COMMON PLEAS COUNTY OF JASPER CASE NO.: 2025-CP-27-00022 US Bank Trust National Association as NOTICE OF SALE Trustee for LB-Cabana Series IV Trust, Deficiency Judgment Waived Plaintiff, v. James Fair, Jr., Defendant, BY VIRTUE of the decree heretofore granted in the case of: US Bank Trust National Association as Trustee for LB-Cabana Series IV Trust vs. James Fair, Jr., the undersigned Special Referee for Jasper County, South Carolina, will sell on December 2, 2025, at 11:00 a.m. at the Jasper County Courthouse, 265 Russell Street, Ridgeland, SC 29936, to the highest bidder: All that certain piece, parcel or lot of land situate, lying and being in Jasper County, South Carolina, containing one (1) acre, more or less, and measuring and being bound as follows: On the Northeast for a distance of 580 feet by Lands of R.B. Kirby; on Southeast for a distance of 75 feet by S.C. Highway #462; on the Southwest for a distance of 580 feet by Lands of James Fair, Sr., and on the Northwest for a distance of 75 feet by Lands of James Fair, Sr. This is more particularly described by a Plat prepared by Joe P. Miley, Registered C.E. and L.S., dated April 27, 1971. A review of the records of Jasper County Register of Deeds reflect that the above referenced plat was recorded in Book 11 at page 452. Being the same fee simple property conveyed by warranty deed from Florrie Fair and James Fair, Sr., to James Fair, Jr., dated August 24, 1971, and recorded on August 24, 1971, in Book 68, page 71 in Jasper County Records, State of SC. PROPERTY ADDRESS: 2459 Gillison Branch Road, Pineland, SC 29934 TMS#: 016-00-03-035 TERMS OF SALE: The successful bidder, other than the Plaintiff, will deposit with the Special Referee, at conclusion of the bidding, five percent (5%) of his bid, in cash or equivalent, as evidence of good faith, same to be applied to the purchase price in case of compliance, but to be forfeited and applied first to costs and then to the Plaintiff's debt in the case of non-compliance. Should the last and highest bidder fail to comply with the other terms of the bid within thirty (30) days, then the Special Referee may re-sell the property on the same terms and conditions on some subsequent Sales Day (at the risk of the said highest bidder). No personal or deficiency judgment being demanded, the bidding shall not remain open after the date of sale and shall be final on that date, and compliance with the bid may be made immediately. Purchaser to pay for documentary stamps on the Deed. The successful bidder will be required to pay interest on the amount of the bid from date of sale to date of compliance with the bid at the rate of 4.50000% per annum. The sale shall be subject to taxes and assessments, existing easements and restrictions of record, and any other senior encumbrances. Plaintiff may waive any of its rights, including its right to a deficiency judgment, prior to sale. In the event an agent of Plaintiff does not appear at the time of sale, the within property shall be withdrawn from sale and sold at the next available sales date upon the terms and conditions as set forth in the Special Referee's Order and Judgment of Foreclosure and Sale or such terms as may be set forth in a supplemental order. This sale is subject to all title matters of record and any interested party should consider performing an independent title examination of the subject property as no warranty is given.
