NOTICE OF PUBLIC HEARING A public hearing will be held by the City Council of the City of Modesto on Tuesday, November 25, 2025, at 5:30 p.m. in the Chambers, Basement Level, Tenth Street Place, 1010 10th Street, Modesto, California, regarding the application of Self-Help Enterprises for "McClure Meadows" project (file number: PLAN2025-00176), property located at the 3401 N. McClure Road, with the Assessor's Parcel Number: 033-089-04. The application involves the approvals listed below: A proposed rezone from Highway Commercial (C-3) to Low Density Residential (R-1). The Planning Commission recommended approval to the City Council at the October 20, 2025, Planning Commission meeting. Notice is hereby given that an Initial Study (IS), Environmental Assessment No. EA/C&ED No. 2025-19 has determined that the Project will not have a significant effect on the environment with the implementation of specific mitigation measures, which include the following: Time restrictions for noise-generating construction activities. All noise-producing equipment and vehicles using internal-combustion engines shall be equipped with manufacturers' recommended mufflers. Material stockpiles and mobile equipment staging, parking, and maintenances areas shall be located as far as practicable from the existing residences to the north and west. Site access road speed limits shall be established and enforced during construction. Notification of construction hours and durations shall be provided to the existing residences to the residences to the north and west of the project site. If unusual circumstances or emergencies prevent certain construction activities from complying with City requirements, a noise control plan shall be developed to ensure that sufficient mitigation is implemented during construction to avoid adverse noise impacts. Based on substantial supporting evidence provided in the IS, the City proposes adopting a Mitigated Negative Declaration (MND). All interested persons are invited to attend the public hearing at the above time and place and will be given an opportunity to be heard. If you challenge the proposed action in court, you may be limited to raising only those issues you or someone else raised at the public hearing described in this notice, or in written correspondence delivered to the City Council at, or prior to, the public hearing.
