O2025-569 NOTICE IS HEREBY GIVEN that the Pierce County Council will hold a public hearing on November 18, 2025, at 3:00 p.m. in the Pierce County Council Chambers, Room 1045, 10th Floor, 930 Tacoma Avenue South, Tacoma, WA, 98402 to consider the following: Proposal No. O2025-569, An Ordinance of the Pierce County Council Levying an Assessment in 2025, for Collection in 2026, Against Land in Pierce County for the Control of Noxious Weeds; and Acknowledging Receipt of the Pierce County Noxious Weed Control Board's 2026 Annual Budget. Section 1. There shall be levied against all benefiting lands in Pierce County in 2025, for collection in 2026, an assessment for the control of noxious weeds. Section 2. The assessment rate for non-exempt rate parcels shall be as follows: $1.79 per parcel in 2026, plus $0.16 per acre, except that platted parcels of unknown size shall be treated as if they were less than one acre in size and that they shall further be assessed only the per parcel charge. Section 3. The following lands shall be exempt as they receive no special benefit or are exempt under the following codes and shall not be assessed: 1. All parcels consisting of mineral rights only per RCW 17.10.240. 2. All parcels consisting of buildings only per RCW 17.10.240. 3. All undivided interest parcels per Pierce County Code 18F.30.030 E. 4. All U.S. government Exempt lands per RCW 84.36.010. 5. All Native American Exempt lands per RCW 84.36.010. 6. All State Assessed Utilities per RCW 84.12.200. 7. All parcels with less than $500.00 value per RCW 84.36.015. 8. All Pierce County Tax Title lands per RCW 36.35.100. 9. All Pierce County Authority and/or Housing Authority lands per RCW 35.82.030. 10. All Church properties determined exempt from Ad Valorem tax by the Washington State Department of Revenue. 11. All parcels owned by Washington State Department of Transportation (WSDOT) as granted in summary judgement in WSDOT's favor by the Thurston County Superior Court in Kittitas County v. Dept of Transp., 13 Wn.App.2d 79,461 P.3d 1218 (2020), and affirmed by the Court of Appeals. Section 4. Pursuant to RCW 17.10.240(1)(a), the amount of the assessment constitutes a lien against the property. Notice of the lien shall be sent to each owner of property for which the assessment has not been paid by the date it is due and that each lien created be collected by the Pierce County Assessor-Treasurer in the same manner as delinquent real property tax, if within thirty days from the date the owner is sent notice of the lien, including the amount thereof, the lien remains unpaid and an appeal has not been made pursuant to RCW 17.10.180. Section 5. The Pierce County Assessor-Treasurer shall collect an annual fee of 1 percent of the assessment to be collected to reimburse the County for the costs of collection. Section 6. All liens created shall bear interest at the rate of 12 percent per annum, and such interest shall accrue as of the date notice of the lien is sent to the property owner. Section 7. The County hereby acknowledges receipt of the 2026 Annual Budget for the Pierce County Noxious Weed Control Board as required by RCW 17.10.240(1). The Board's budget is shown on Exhibit A, which is attached hereto and incorporated herein by reference. This hearing date was set by action of the Pierce County Council at its November 4, 2025, meeting.
