NOTICE OF SALE UNDER POWER GEORGIA, BIBB COUNTY By virtue of a Power of Sale contained in that certain Security Deed from ELIZABETH CLOWERS GAINEY to FINANCIAL FREEDOM SENIOR FUNDING CORPORATION, A SUBSIDIARY OF INDYMAC BANK, F.S.B., dated July 20, 2005, recorded August 1, 2005, in Deed Book 6719, Page 256-264, Bibb County, Georgia Records, said Security Deed having been given to secure a Note of even date in the original principal amount of Seventy-Nine Thousand Five Hundred and 00/100 dollars ($79,500.00), with interest thereon as provided for therein, said Security Deed having been last sold, assigned and transferred to GITSIT Solutions, LLC, not in its individual capacity but solely in its capacity as Separate Trustee of GV Trust 2025-1, there will be sold at public outcry to the highest bidder for cash at the United Building in Central City Park, located at 206 7th Street, Macon Georgia, within the legal hours of sale on the first Tuesday in December, 2025, all property described in said Security Deed including but not limited to the following described property: ALL THAT TRACT OR PARCEL OF LAND LYING AND BEING THE MACON RESERVE IN BIBB COUNTY, GEORGIA, KNOWN IN THE PLAN OF THE L.W. DUBOISE SURVEY OF THE LANDS OF THOMAS WOOLFOLK, DECEASED, ON THE EASTSIDE OF THE OCMULGEE RIVER AS PART OF BLOCK N IN SAID SURVEY, DESCRIBED BY METES AND BOUNDS AS FOLLOWS: COMMENCING AT A POINT ON FORT HILL STREET 104 FEET 5 INCHES FORM THE CORNER FORMED THE INTERSECTION OF SAID FORT HILL STREET WITH A STREET SEPARATING BLOCK N FROM BLOCK O ON SAID SURVEY; EXTENDING THENCE ALONG FORT HILL STREET IN A NORTHERLY RECTION 104 FEET 3 INCHES, MORE OR LESS, AND HAVING A PERPENDICULAR DEPTH OF 104 AT 5 INCHES, MORE OR LESS, BEING IN THE SHAPE OF A SQUARE, CONTAINING ONE-FOURTH OF MORE, FORMING THE NORTHEAST QUARTER OF THE ONE ACRE SOLD AND CONVEYED BY HARDIN T. JOHNSON TO MATTIE SIMMONS (SIMS) BY DEED DATED JANUARY 4, 1896, AND RECORDED IN DEED OK JJ. PAGE 624, IN THE CLERK'S OFFICE OF THE BIBB SUPERIOR COURT; SAID TRACT OF LAND IS BOUNDED AS FOLLOWS: EAST BY FOR HILL STREET, NORTH BY AN ALLEY SEPARATING SAID PROPERTY (SIMS), AND SOUTH BY THE SOUTHWEST ONE-FOURTH OF LOT SOLD TO EUGENIA PORTER. THIS IS THE SAME TRACT OF LAND CONVEYED BY JAMES LOWE TO MARY HARRIS (HE SAME PERSON AS MARY CLOWERS HARRIS) AND NEAL HARRIS BY DEED DATED OCTOBER 29, 1917, AND OR RECORD IN SAID CLERK'S OFFICE IN DEED BOOK 219, PAGE 536, ALSO, ALL THAT TRACT OR PARCEL OF LAND LYING AND BIND IN BIBB COUNTY, GEORGIA AND IN THE MACON RESERVE OF THE OCMULGEE RIVER, AND BEING ONE-FOURTH OF AN ACRE LOT OFF THE SOUTHEAST CORNER OF THAT TRACT OR PARCEL OF LAND KNOWN THE PLAN OF THE L.W. DUBOISE SURVEY OF THE LAND OF THOMAS WOOLFOLK, DECEASED, OF THE SOUTHEAST CORNER OF BLOCK N, RUNNING PARALLEL WITH THE LOT OR LAND ABOVE DESCRIBED. THIS IS THE TRACT OF LAND CONVEYED TO NEAL HARRIS BY MATTIE SIMS BY DEED DATED MARCH 22, 1922, AND OF RECORD IN THE SAID CLERK'S OFFICE IN DEED BOOK 255, PAGE 170. EXCEPTED FROM THE ABOVE IS THE LOT HERETOFORE CONVEYED TO PINKNEY CLOWERS, JR. THE IMPROVEMENTS THEREON BEING COMMONLY KNOWN AS 1392 FORT HILL STREET, MACON, GEORGIA 31217. BEING THE SAME LOT OR PARCEL OF GROUND WHICH BY DEED DATED APRIL 1989 AND RECORDED AMONG THE LAND RECORDS OF BIBB COUNTY IN BOOK 2008 PAGE 5, WAS GRANTED AND CONVEYED BY RAY V. GAINEY, UNTO ELIZABETH CLOWERS GAINEY. Said legal description being controlling, however the property is more commonly known as 1392 FORT HILL ST, MACON, GA 31217. The indebtedness secured by said Security Deed has been and is hereby declared due because of default under the terms of said Security Deed. The indebtedness remaining in default, this sale will be made for the purpose of paying the same, all expenses of the sale, including attorneys' fees (notice to collect same having been given) and all other payments provided for under the terms of the Security Deed. Said property will be sold on an "as-is" basis without any representation, warranty or recourse against the above-named or the undersigned. The sale will also be subject to the following items which may affect the title: any outstanding ad valorem taxes (including taxes which are a lien, whether or not now due and payable); the right of redemption of any taxing authority; matters which would be disclosed by an accurate survey or by an inspection of the property; all zoning ordinances; assessments; liens; encumbrances; restrictions; covenants, and any other matters of record superior to said Security Deed. To the best of the knowledge and belief of the undersigned, the owner and party in possession of the property is ELIZABETH CLOWERS GAINEY, ESTATE AND/OR HEIRS-AT-LAW OF ELIZABETH CLOWERS GAINEY , or tenants(s). The sale will be conducted subject (1) to confirmation that the sale is not prohibited under the U.S. Bankruptcy Code and (2) to final confirmation and audit of the status of the loan with the holder of the Security Deed.
