NOTICE OF SALE UNDER POWER IN DEED TO SECURE DEBT GEORGIA, BIBB COUNTY. By virtue of the power of sale contained in the DEED TO SECURE DEBT given by SPRY HOLDINGS, LLC to MORRIS BANK dated June 8, 2022, and recorded in Deed Book 11281, Pages 260-267, in the Office of the Clerk of the Superior Court of Bibb County, Ga., conveying the below-described property, to secure that certain Commercial Line of Credit Renewal Agreement and Note given by STUSA 007 LLC to MORRIS BANK in the original principal amount of $231,170.35 with interest thereon as set forth therein, there will be sold by the undersigned at public outcry to the highest bidder before the Courthouse Door at Bibb County, Georgia, within the legal hours of sale, on the first Tuesday in December, 2025, the following described property: All that tract or parcel of land situate, lying and being in Macon-Bibb County, Georgia, being known and distinguished as Lot No. 1 and Lot No. 2 of The Hime Property, being more particularly described according to plat prepared by James W. Moncrief Surveyor dated September 1954 and of record in Plat Book 25, Page 183, Clerk's Office, Bibb Superior Court, which said plat is by this reference thereto incorporated herein for the purpose of a more particular and accurate description of said Lot No. 1 and Lot No. 2 hereby conveyed. There are improvements taxed thereon known under the present system of numbering as 1877 Houston Avenue, Macon, Bibb County, Georgia. Having a Tax Map Parcel No. of Q083-0440. The property hereinabove described and conveyed is one of the properties conveyed to SPRY Holdings, LLC by Whitby, lnc. by Quit Claim Deed dated October 31, 2021 and recorded in Deed Book 11063, Page 23, Clerk's Office, Bibb Superior Court. This property is conveyed subject to a perpetual ingress and egress easement in favor of Curtis L. Hawkins and Cynthia Hawkins of record in Deed Book 1758, Page 451, Clerk's Office, Bibb Superior Court. This conveyance is made subject to all zoning ordinances, conditions, easements. restrictions and covenants of record. Reference is hereby made to the above described plat and deed for the purpose of a more particular and accurate description of the property hereby conveyed. THE ABOVE PROPERTY IS LOCATED AT: 1877 HOUSTON AVENUE, MACON, GEORGIA 31201. To the best knowledge and belief of the undersigned, the person or persons who may be in the possession of such property is SPRY Holdings, LLC. The debt secured by said Deed to Secure Debt has been and is hereby declared due because of, among other possible events of default, failure to make payments in accordance with the terms of said Commercial Line of Credit Renewal Agreement and Note. The debt remaining in default, this sale will be made for the purpose of paying the same, and all expenses of sale, including attorney's fees. Said property will be sold subject to all outstanding ad valorem taxes and/or assessments and/or restrictions and/or zoning ordinances and/or covenants; matters that may be disclosed by an accurate survey and/or inspection of the property; and matters of record superior to the Deed to Secure Debt. Notice has been given of intention to collect attorney's fees in accordance with the terms of the Commercial Line of Credit Renewal Agreement and Note secured by the property. Additionally, this sale will be conducted subject to (1) confirmation that the sale is not prohibited under the U. S. Bankruptcy Code and (2) final confirmation and audit of the status of the loan with the holder of the (Security Deed)(Deed to Secure Debt).
