NOTICE OF FORECLOSURE SALE UNDER POWER
MUSCOGEE COUNTY, GEORGIA
Under and by virtue of the Power of Sale contained in a Security Deed given by Theodore A. Rowley to Mortgage Electronic Registration Systems, Inc., as grantee, as nominee for SunTrust Mortgage, Inc., dated August 27, 2012, and recorded in Deed Book 10669, Page 276, Muscogee County, Georgia Records, subsequently modified by a Loan Modification Agreement recorded January 9, 2024 in Book 14313, Page 152 in the amount of One Hundred Twenty-Seven Thousand Four Hundred Ninety-Three and 44/100 ($127,493.44) Muscogee County, Georgia Records, subsequently modified by a Loan Modification Agreement recorded April 14, 2025 in Book 14655, Page 23 in the amount of One Hundred Thirty-Eight Thousand One Hundred Forty-Two and 48/100 ($138,142.48) Muscogee County, Georgia Records, as last transferred to Truist Bank by assignment recorded on July 1, 2021 in Book 13468 Page 100 in the Office of the Clerk of Superior Court of Muscogee County, Georgia Records, conveying the after-described property to secure a Note in the original principal amount of One Hundred Twenty-Five Thousand Six Hundred Seventy-Four and 0/100 dollars ($125,674.00), with interest thereon as set forth therein, there will be sold at public outcry to the highest bidder for cash before the courthouse door of Muscogee County, Georgia, within the legal hours of sale on December 2, 2025, the following described property:
All that lot, tract or parcel of land situate, lying and being in Columbus, Muscogee County, Georgia, being known and designated as ALL OF LOT NUMBERED TWENTY-FIVE (25), IN BLOCK LETTERED "H", SECTION FOUR, REGENCY PARK, as said lot is shown upon a map or plat entitled "Section Four, Regency Park, Lying in Land Lots 9, 10 & 23, 9th District, Columbus, Muscogee County, Georgia", prepared by Moon, Meeks & Patrick, Inc. under date of October 6, 1972, filed for record October 19, 1972, and recorded in Plat Book 52, Folio 82-A in the Office of the Clerk of the Superior Court of Muscogee County, Georgia, to which reference is made for the particular location and dimensions of said lot. Located thereon is house numbered 2708 Skylake Drive, according to the present system of numbering houses in Columbus, Muscogee County, Georgia.
The debt secured by said Security Deed has been and is hereby declared due because of, among other possible events of default, failure to pay the indebtedness as and when due and in the manner provided in the Note and Security Deed. The debt remaining in default, this sale will be made for the purpose of paying the same and all expenses of this sale, as provided in Security Deed and by law, including attorney's fees (notice of intent to collect attorney's fees having been given).
The entity having full authority to negotiate, amend or modify all terms of the loan (although not required by law to do so) is: Truist Bank they can be contacted at (800) 443-1032 for Loss Mitigation Dept, or by writing to 1001 Semmes Avenue, Richmond, Virginia 23224, to discuss possible alternatives to avoid foreclosure.
Said property will be sold subject to any outstanding ad valorem taxes (including taxes which are a lien, but not yet due and payable), any matters which might be disclosed by an accurate survey and inspection of the property, any assessments, liens, encumbrances, zoning ordinances, restrictions, covenants, and matters of record superior to the Security Deed first set out above.
To the best knowledge and belief of the undersigned, the party in possession of the property is Francesca O. Rowley or tenant(s); and said property is more commonly known as 2708 Skylake Dr, Columbus, GA 31907.
The sale will be conducted subject to (1) confirmation that the sale is not prohibited under the U.S. Bankruptcy Code (2) final confirmation and audit of the status of the loan with the holder of the security deed and (3) any right of redemption or other lien not extinguished by foreclosure.
