NAMED BELOW: The Plaintiff(s) Wilmington Trust, National Association, successor Trustee
to Citibank, N.A., as Trustee for the Bear Stearns ALT-A Trust, Mortgage Pass-
Through Certificates Series 2006-4 has filed a complaint with the Land Court. The Complaint
is enclosed with this Citation. TO: Alec G. Sohmer, Trustee of the 1 Diamond Street
Nominee Trust, The Petitioner has filed an S Complaint to Clarify Title to Real Property
and an Amended S Complaint to Clarify Title to Real Property with the land Court (the "Petition"
and the "Amendment"), copies of which are attached hereto. The Petitioner filed the
Petition and the Amendment regarding the Assignment of Mortgage, registered as Document
No. 706160 (the "Assignment") of the Mortgage, registered as Document No. 603160
(the "Mortgage"), both documents noted on Certificate of Title No. 108837. The Petitioner
seeks the Assignment to be amended by Decree of Court to identify correct name of assignee.
An additional Assignment of the Mortgage was registered as Document No.
852009. The Petition and the Amendment relate to a property located at 1 Diamond
Street, Plymouth, Certificate of Title No. 108837, in the Registry District of Plymouth
County. The Petition and the Amendment are also available online and maybe reviewed
at www.masscourts.org. It is ORDERED: that a copy of the above be mailed by certified
mail to the named defendant. It is FURTHER ORDERED: that the Petitioner is hereby ordered
to serve the within notice by publishing the same once in "Charlotte Observer", a
newspaper, published in Charlotte, in the County of Mecklenburg, in the State of North
Carolina, twenty-one days before said return day. If you desire to make objection or defense
to said Petition, you or your attorney must file a written appearance and an answer
under oath setting forth clearly and specifically your objection or defense to each part of
said Petition in the office of the Recorder of this Court at Three Pemberton Square, Room
507, Boston, MA 02108 on or before December 1, 2025. A list of all known interested
parties (persons with an interest in the land) at the time this Citation is issued is included
below. If you, as an interested party, wish to object or defend against this Complaint, you
or your attorney must file a written appearance and an answer. The answer must state
clearly and specifically your objection or defense to each part or paragraph of the Complaint.
You must sign the answer "under oath," which means that you swear or affirm the
answer is true. This appearance and answer must be filed in the office of the Recorder of
the Land Court on or before the DEADLINE TO ANSWER: 12/01/2025.
A copy of this answer must also be served upon (delivered to) the Plaintiff(s) at the address
provided below on or before the above deadline. If you do not respond, you may
lose the chance to tell your side, and the Court may decide the case against you by default
